In compliance with Section 14 of the City Charter, I hereby call a special meeting of the Board of Aldermen to be held:

Date: Monday, January 4, 2010
Time: 8:15 p.m. (Or immediately following the Common Council Meeting)
Place: Peter J. McCarren Memorial Chamber, 484 Broadway, City Hall, Third Floor, Everett, Massachusetts 02149

The subject matters to be considered thereat are as follows:

1. A0001-10 Order: Election of a President of the Board of Aldermen for the calendar year 2010.

2. A0002-10 Order: Adoption of the Board of Aldermen 2009 Rules as the Rules of the Board of Aldermen 2010.

3. C0006-10 Order: To act concurrently on the adoption of the 2009 Joint Rules as the Joint Rules for the calendar year 2010.

4. C0004-10 Order: To act concurrently with the Common Council for the election of Clerk of Committees for the years 2010 and 2011.

5. A0003-10 Order: Newly elected President appoint three Aldermen to notify the Mayor and the Common Council of their organization.

To add new subsections to the Zoning Ordinances, Appendix A, Section 21A. Adult Entertainment Land Use, (b) Definitions, by inserting the following: (6) Pawn Shops, (7) Piercing, (8) Check cashing, (9) Tattoo Parlors and (10) Gun Shops; to restrict the locations of theses establishments thereby promoting the safety and welfare of the City's inhabitants, and to enhance attractive business areas in the City.

18. A0005-10 Resolution/s/Alderman Michael K. Marchese
That the Mayor consider extending the hours of the ECTV Technology Center.

19. A0021-10 Resolution/s/Alderman Michael J. Mangan and Councilor Eloy Sierra
That the City Council request a 15 minute parking space for Nara's Market at 202 Ferry Street for seven (7) days a week from 6 a.m. to 11 p.m.

That the attorneys and parties disputing the ownership of repair shop once known as Majestic Motors appear at the next License Committee meeting for an update as to progress made in resolving dispute.

7. & 8.
O.K., now the city is up to $45,000 in anonymous donations in a relatively short period of time. It really does make you wonder where it's coming from.

11.
For the last three years, the city has budgeted $18,000 for this line item. Now, it needs to increase the line item by 83% in one fell swoop? Obviously, costs are going to rise from year to year and the amount paid for advertising is going to vary based on how much advertising is done but the amount being requested seems excessive. Let's hope that some good questions are asked and some good answers are given.

12.
It's about time that something is being done to address the issue that it appears that a repair shop is still being run at 67R Chelsea Street. I don't think that this license should be considered for approval without some serious questioning about what's been going on there. Probably best if the piece get referred to the License Committee.

17.
I didn't post any comments after the last Alderman's meeting because I didn't think that there was anything really worth commenting on. But to tell the truth, I didn't catch the public hearing on this piece until much later in the week and it did deserve some comment. There were a lot of fingers being pointed on the failure of this piece to be passed in the last legislative session. And truth be told, there were a number of factors that caused the problems; lots of blame to be shared.

But to me though, Alderman Marchese ought to look in the mirror first to find someone to blame before he starts pointing fingers at others. Just because you put something on the agenda that you think is a good idea doesn't mean that it will automatically pass. Why didn't he attend the Planning Board meeting? I know that it is held at the same time as the BOA meeting but he could have excused himself. He hadn't even looked into why the Planning Board had voted unfavorably on the piece before the last BOA meeting. Hopefully, he and others can learn from this. In my opinion, too many of the members of the City Council don't take the legislative portion of their positions seriously enough.

Glad to see that the alderman truly believes in this piece; he kept his word and put the piece back on the agenda immediately. But, I expected to see his pit bull/vicious dog piece again too.

MassDee--why is it the end of the story?
Tetris,the most knowledgeable person on this forum, even said he would like to know who donated the money.

Paul,

I think that Massdee just meant that the donation was accepted without a lot of further questioning. It was clarified though that if someone wanted to find out who the donor was, the city knew who it was and it could be disclosed under a Freedom of Information Act request.

As far as the lastest anonymous donations, they were referred to the Finance Committee meeting by a motion made by Alderman Marchese. I guess that some of the aldermen have questions about these donations as well.

A few other tidbits from tonight's meeting.

- All of the other donations were accepted.

- The request for additional advertising dollars was cut in half ($7,500) by the administration. It was reported that the line item was overspent in the FY09 budget by $5,000 and was level funded at the original FY09 amount in the FY10 budget. It looked like they were on target to come in somewhere around the budgeted amount in the FY010 proposed budget document on the city web site but it's hard to tell without a lot more information. The request was approved as amended.

- The license for Carlos Used Cars was referred to the License Committee. If approved, this will only allow them to service cars that they sell. There is still something in the works with trying to get a repair shop license at that location. But that seems to be held up in some legal wranglings.

- The remainder of the licenses were approved. A new license was added under suspension; that was sent to the License Committee. Majestic Motors piece sent to License as well.

- Alderman Marchese accepted some of the blame for his zoning piece failing and submitted definitions of each of the type of establishments that he trying to restrict. The item was referred to R & O.

- Everyone thought that extending the hours of the ECTV Technology Center was a good idea. The piece was referred to the Mayor, ECTV and the City Solicitor to answer Alderman Mangan's question of whether or not donations can be used to subsidize the program.

- 15 minute Parking piece referred to Traffic.

Paul, I should of used a better choice of words. Tetris is exactly correct. I meant there was not much discussion on this piece two weeks ago, they voted to accept it and moved on. I have not seen last nights meeting so I can't comment on that.

Tetris, Thanks for clarifying my post. Were there any discussions on the anonymous donations last night? Or, did they just send it to the Finance Committee?

Not a lot. Alderman Marchese said something along the lines that he was concerned where this was going. No one else said much of anything specifically about the issue as I recall. Alderman Sachetta did ask some questions in general about who controls how the money is spent after a donation is accepted. The answer given to that as I recall was the appropriate department head, monitored by the treasurer and the auditor. That's pretty much in line with how the budget is managed as well and in conformity with MGL as I recall from prior research that I've done about accepting donations.

Does the person who is making the donation specify which department the donation goes or is that done by the Administration?

So, if we were to call or email the City Clerk we could get the information on who is making these donations?

I believe that the entity making the donation specifies its use. I'm not sure who would handle a request for the information.

Mystery Donations Continue!

We made a Public Information Request to
the City Auditor for the Name of the Donor
of $25,000.00.

Don't be surprised if it's Wood Waste of
Boston.

They are trying to make themselves more
deals down lower Broadway.
