ordinances or parts of ordinances in conflict herewith.

That the City Services Director Kevin Noonan appear next meeting with regards to the
amount of money, so far, that was spent on snow budget.

That a letter be sent to the Whidden Hospital asking them if they can keep the parking
garage open during snow storms so residents can park.

To have the City examine the possibility of granting residents a 10% credit or discount on
their residential water bill portion only, and that these residents meet the following criteria:

1. That the payee of the water bill be the owner occupant.

2. That the payee is up to date and current on all water bills with no liens against their property.

3. That the owner occupant only be allowed to claim the percentage of the credit/discount in proportion to their actual living space, if they reside in a multi-family home. 4. That this credit/discount only applies to the residential and not commercial water bills.

5. That an assessment 10% is added to the water bill for late payment, and that these funds that are collected go directly to the Water Enterprises. To be used at the discretion of the Water Superintendent as needed for equipment, tools materials and labor.

That Rule 8 - Order of Business be replaced with the following:
Common Council Rule 8-Order of Business

At every regular meeting of the Common Council the order of business shall be as
follows:

1. Roll Call.
2. Presentation of petitions, memorials and remonstrance’s.
3. Public Participation.
4. Communications from His Honor the Mayor.
5.Papers from the Board of Aldermen.
6. Communications and reports from City Officers.
7. Report of Committees.
8. Unfinished Business.

9. Ordinances, orders and resolutions (New Business).
That Rule 10A - Public Participation be inserted after Common Council Rule 10 as
follows:

Common Council Rule 10A-Public Participation

1). Each formal session of the Common Council shall include, subject to the provisions of
Common Council Rule 8, a period of public participation which shall last up to ten (10)
minutes. The subject matter of the public participation shall not be limited to the items
before the Common Council at the present formal session. For the purpose of this rule,
the term "public" shall be construed to mean any member of the public at large and not
limited as to restrict any individual from participation.

2). Each member of the public shall place their name, address and brief description of
their topic on the sign in sheet prior to the start of the formal session of the Common
Council.

3). Each member of the public shall be limited to no more than two (2) minutes of
participation without unanimous consent of the members present. Large groups should
designate a spokesperson to speak on a particular issue.

4). This rule does not limit or replace the provisions of the Common Council Rule 16,
which remains in full effect.

5). All comments are to be addressed to the President. Participants shall not promote or
oppose any candidate running for office.

Participants shall not use Public Participation to Exploit, or for Political Purposes.
Participants shall not advertise.
Participants shall not make personal attacks on council members or elected officials.
Anyone making out of order comments or acting in an unruly manner shall be subject to
removal from the meeting.
This Rule shall be posted in the Chambers for public viewing and understanding of Rules.

That Chief Mazzie show us crime rates for 2003, 2006, 2010 and 2012 for six major
crimes, as follows: murder, robbery, assaults, burglary, theft and motor vehicle theft, in
each year in our City.

That the Mayor considers any funded position that is non-essential, be eliminated from
the budget this year.

That in accordance with the provisions of Section4-4 of the Everett City Charter and all applicable Ordinances of the Revised Ordinances of the City of Everett, and Chapter 71, Section 52 of the General Laws of Massachusetts, the salary of the members of the school committee shall be increased from $5,500.00 to $11,500.00 annually, effective January 1, 2014.

All permanent full-time non-union and administrative officers and employees that are department heads shall receive a longevity payment as follows: 10 years' service $800, 15 years' service $1,300, 20 years' service $1,700. Payment shall be made on the anniversary date of employment. If an officer or employee terminates service, by death or retirement, they shall be entitled to a pro-rated payment based on the number of whole months of service since the previous anniversary date." All ordinances or parts of ordinances in conflict with the foregoing are hereby repealed.

By the City Council of the City of Everett: Be it enacted by the Senate and the House of Representatives in General Court assembled and by the authority of the same, as follows:

Section 1. Notwithstanding Section 7 of Chapter 32 of the General Laws or any other general or special law to the contrary, and in order to promote the public good, the State- Everett Retirement Board shall retire Michael Marchese, a Police Officer of the City of Everett, who as a result of injuries sustained while in the performance of his duties is totally and permanently injured and incapacitated for further service as a Police Officer. Michael Marchese shall receive a yearly amount of pension equal to the regular rate of compensation which would have been paid had he continued in service as an Everett Police Officer at the grade held by him at the time of his retirement. Upon passage of this petition, the Retirement Board of the City shall immediately pay him all amounts credited to him in the annuity savings fund of the Retirement Board of the City.

Section 2. Upon the death of Michael Marchese, with his Wife surviving him, the State-Everett Retirement Board shall pay to her so long as she remains unmarried, an annuity in the amount of three-fourths of the amount of the pension payable to him at the time of his death, and $530.00 for each child of Michael Marchese during the time that the child is under 18 years of age or over that age and physically or mentally incapacitated from working. If his spouse remarries, the City shall pay, in lieu of this annuity to her, an amount equal to the amount of pension payable to Michael Marchese at the time of his death, to and for the benefit of the Children of Michael Marchese who are under 18 years of age or physically or mentally incapacitated from working. Furthermore, the School Department built its FY 2014 budget using the Governor's recommended budget, which will also likely force the school department to modify its budget at some point. I think that it would be helpful if we had access to an agenda for the joint convention so that we could see if it contains any additional information about items 4 through 6. It's really difficult to fully understand those without more information. The press release that was in the paper this week about these items wasn't much more help either. I think some that a lot more information needs to be made available about these items before they vote on them, especially the redevelopment authority piece.

ORDER: Alderman Salvatore Sachetta, as President and Councilor John Leo McKinnon, as President:

WHEREAS: In order to address the existence of decedent, blighted, insufficient infrastructure, shortage of developable land and obstacles to private investment the City of Everett is empowered by Massachusetts General Law Chapter 121B, Section 4 to create a public body politic known as a “Redevelopment Authority” to exercise powers granted to it by Massachusetts General Law; and

WHEREAS: Such Authority will consist of five members, whose membership shall be consistent with and determined by the provisions of Massachusetts General Law Chapter 121B, Section 5; and

WHEREAS: It has been determined by the City of Everett, acting by and through its Mayor and City Council, that there is a need for the creation of a redevelopment authority for the purposes of engaging in urban renewal projects and other activities authorized by Massachusetts General Law Chapter 121B; and

WHEREAS: It is in the public interest that such a redevelopment authority be organized in the City of Everett pursuant to Massachusetts General Law; it is therefore

ORDERED: That a redevelopment authority, to be known as the “Everett Redevelopment Authority” shall be organized in the City of Everett, pursuant to the provisions of Massachusetts General Law Chapter 121B, Section 4 and acts in amendment thereof and in addition thereto.

WHEREAS: Substandard, decadent or blighted open areas exist in the City of Everett constitute a growing and serious menace, injurious and inimical to the safety, health, morals and welfare of residents of the City of Everett; and

WHEREAS: The menace of such decadent, substandard or blighted open areas is beyond remedy and control solely by regulatory process in the exercise of police power currently available to the City of Everett and the ordinary operations of private enterprise; and

WHEREAS: It is hereby determined by the City of Everett, by and through its City Council and Mayor, that a Redevelopment Authority is needed for the acquisition, planning, clearance, conservation, rehabilitation or rebuilding of such decedent, substandard and blighted open areas for residential, governmental, recreational, educational, hospital, business, commercial, industrial or other purposes, it is therefore

ORDERED: That the City of Everett hereby adopts the provisions of Massachusetts General Law Chapter 121B relative to the establishment of a redevelopment authority and in that connection to make any and all determinations and declarations deemed necessary or desirable, and take any action in relation thereto.
