Anybody know why ECTV is running a notice that the Mayor's Mid-Term Address has been rescheduled until 2/7 and instead, there is a special meeting of the Common Council scheduled for 6:30 PM?

Not sure why he moved the mid-term address to February (speculation is it has to do with his "accomplishments" for his speech writer) and the Common Council meeting is about Air Force Road.....I heard.

All the Everett papers said January 10th...but not the Boston Globe.

Midterm address
January 9, 2011
Mayor Carlo DeMaria Jr. will deliver his midterm address to a joint convention of the Common Council and the Board of Aldermen Feb. 7 at 6:30 p.m. in the City Council chambers in City Hall. DeMaria, who is midway through his second two-year term, will discuss recent city initiatives and the challenges and opportunities he sees for Everett in the year ahead. The meeting will be broadcast live by Everett Community Television on Channel 16. Meanwhile, the aldermen and the Common Council, which together make up the City Council, reorganized last week. The aldermen chose Ward 3 member Michael K. Marchese as president and the council selected Ward 1 member Sergio Cornelio as its president for the coming year.

Thanks for the info...I'm sure the date must have changed after the Everett papers went to press.

Just another example of why agendas need to get posted more promptly. Nobody seems to be getting the message about that. Seems like ECTV got the message when I mentioned last week that they weren't running programming schedules any more...noticed that they were back when I found this other info on their message boards this weekend. You just can't stop doing something that has been done almost like clockwork for the better part of four years and people have found to be useful not expect anyone to have something to say about it.

Capitol Waste held a big fundraiser for Carlo in May of 2009 at the Winthrop Arms, and then just after that, they charged the city for extra tonnage. It was questionable.

Is it customary for the city to sign five year contracts for our trash removal?

I am very uneasy about the BOA approving the Water and Sewer Enterprise Fund. Alderman DiPerri made a lot of sense. I agree, it's an accounting tool, but it certainly isn't an accountable tool. Watch out, it looks like our water bills are going to go through the roof.

In my opinion it’s a bad judgment call. The administration was aware of the problems with Capitol prior to signing the five year agreement and good luck even trying to get out of that contract. Capitol will have them tied up in so much litigation Mejia’s head would spin.

All that "accounting tool" was for the Water and Sewer Enterprise Fund was to take it out of the budget, since we are so close to Pro 2 1/2. Who was the one that changed their mind?

I'm not pretending that I understand state procurement laws but I don't get why a trash hauling contract should be exempt from 30B. If it wasn't exempt, I don't believe that it could be more than 3 years. I sort of recall a contract for more than 3 years having to be approved by city council (or maybe just the aldermen?) back in the short-lived Clayton Carlisle days. I'll try to track that down but since the old agendas and meeting minutes have gone bye-bye off the city web site, it makes this type of research a lot harder. I was happy that RVC asked the question about the length though.

It almost sounded like a decent deal that the new trash hauling amount would be in the same ballpark for five years, around $1.5 million. But then I looked at what was budgeted for FY11, slightly over $1.3 million. So, a 15% increase over the current contract! Sorry, it should have gone out to bid.

As far as the enterprise fund goes, RVC and Sachetta voted for it the last time; I believe Mangan was for it but it was voted on when he was absent. I assumed that Millie Cardello must have changed her mind on it as there would have been no reason to reintroduce it otherwise, since none of the other no votes on the BOA would have changed their vote.

While I support the goal of the enterprise fund (water users pay for all water expenses), I believe that there is a loophole with its implementation. Any expenses shifted from the operating budget to the enterprise fund should be subtracted from the prior year's levy limit before calculating the next year's levy limit. This would avoid back-dooring Prop 2 ½. Unfortunately, state law doesn't appear to include such a provision.

Also, while I think that there are adequate protections in the law to control the expenses of the water department (approval of their budget and appropriations of any excess funds), they certainly aren't as iron-clad as Prop 2 ½ is. Protection of water payers interests would be solely in the hands of the city council. Not sure what to think about that; might work or it could be ugly.

The entire enterprise item was a piece of work.

1st off, no one but the alderman seen the agenda until the day of the meeting. I'm ticked off that the public was not alluded to the fact that it was even on the agenda (of course, I know we always have the infamous "Glass Case") then, the madam alderman Cardello conveniently changes her mind and never lets on why? What a work in progress!

Was that piece brought back right, since it failed before? Don't you have to file for reconsideration?

Am I also to assume that Capitol was exempt under Appendix A - # 30? If so, I could have sworn that Jill said Recycle was not exempt? I could be wrong.

When you are talking about a contact over a million dollars of TAXPAYER money a year, this is one item that SHOULD be put out to bid (if anything, for the best interest of the city) AND even on a State level it should NOT be exempt from 30B.

It boggles my mind that this administration goes and signs a 5 YEAR contract to a company that has not complied with the constituents of Everett and knowing perfectly well the complaints of Everett residents for late trash pick-up and that was NOT worded in the 5 year contract?? What's going on here?? I wonder how many more fundraisers & donations they will be giving the mayor after this?

Appendix A
Contracts Exempt from Chapter 30B

The following supply and service contracts are exempt from the requirements of Chapter 30B.

1. Public construction contracts subject to the provisions of M.G.L. c.30, §39M, M.G.L. c. 25A, §11I, or M.G.L. c.149, §§44A through 44J, inclusive. [M.G.L. c.30B, §1(b)(1).] See Chapter 9 for information on design and construction projects.

2. Public building design contracts subject to the provisions of M.G.L. c.7, §§38A½ - 38O, inclusive. [M.G.L., c.30B, §1(b)(2).] See Chapter 9 for information on design and construction projects.

3. Intergovernmental service agreements under the provisions of M.G.L. c.40, §4A. [M.G.L. c.30B, §1(b)(3).]

4. Agreements with the Commonwealth. [M.G.L. c.30B, §1(b)(4).]

5. Contracts for the purchase of materials, under specifications of the Massachusetts Highway Department, and at prices established by the Department, pursuant to advertising and bidding for such purpose, in connection with work to be performed under the provisions of M.G.L. c.81 or M.G.L. c.90. Other supplies and services, however, are not exempt simply because they are procured by the special education department.

For example, office supplies or computers to be used for office administration would not fall under this exemption.

9. A contract to purchase supplies or services from, or to dispose of supplies to, any agency or instrumentality of the federal government, the commonwealth or any of its political subdivisions or any other state or political subdivision thereof. [M.G.L. c.30B, §1(b)(9).]

10. The issuance of bonds, notes or securities in accordance with procedures established by law. [M.G.L. c.30B, §1(b)(10).] A-1

11. Contracts and investments made in connection with deferred compensation programs for employees in accordance with sections 57 or 57A of M.G.L. c.35 or sections 67 or 67A of M.G.L. c.44. [M.G.L. c.30B, §1(b)(11).]

12. A contract for the procurement of insurance or surety bonds, including an
agreement subject to the provisions of sections 1 to 16, inclusive, of M.G.L. c.40M or sections 25E to 25U, inclusive, of M.G.L. c.152. [M.G.L. c.30B, §1(b)(12).] The procurement of an insurance contract is exempt from Chapter 30B. Contracts for insurance-related services, however, are not exempt. You must follow Chapter 30B to procure insurance consulting, claims administration, or third-party billing services.

13. Contracts for the services of expert witnesses for use in an adjudicatory proceeding or litigation or in anticipation thereof. [M.G.L. c.30B, §1(b)(13).]

14. Contracts or agreements entered into by a municipal gas or electric department governed by a municipal light board, as defined by section 55 of M.G.L. c.164 or by a municipal light commission, as defined by section 56A of c.164; provided, however, that any such board or commission may accept the provisions of this chapter by a majority vote of its members. [M.G.L. c.30B, §1(b)(14).]

15. Contracts with labor relations representatives, lawyers, designers, or certified public accountants. [M.G.L. c.30B, §1(b)(15).]

This exemption applies only to services that could reasonably be restricted exclusively to labor relations representatives, lawyers, designers, or certified public accountants. Service contracts are not exempt from Chapter 30B simply because you select a labor relations representative, lawyer, designer or certified public accountant to perform the service. For example, a contract to computerize your accounting system is subject to Chapter 30B even if you contract with a CPA firm. Similarly, a contract to operate a water treatment facility is subject to Chapter 30B even if you choose an engineering firm, because the services for which you are contracting are not design services. Finally, keep in mind that contracts with architects and other designers for design services in connection with a building are subject to the designer selection law, M.G.L. c.7, §§38A½ - 38O. See Chapter 9 for more information on building design contracts.

16. Contracts with physicians, dentists, and other health care individuals or persons including nurses, nurses’ assistants, medical and laboratory technicians, health care providers including diagnosticians, social workers, psychiatric workers, and veterinarians. [M.G.L. c.30B, §1(b)(16).] This exemption applies only to services that could reasonably be restricted exclusively to physicians, dentists, and other health care individuals or entities. Other health care-related service contracts are not exempt from Chapter 30B simply because you select a physician, dentist or other health care individual to perform the service.

17. A contract for snow plowing services. [M.G.L. c.30B, §1(b)(17).]

18. A contract or lease by a governmental body of its boat slips, berths, or moorings. [M.G.L. c.30B, §1(b)(18).]

19. A contract for retirement board services. [M.G.L. c.30B, §1(b)(19).]

20. A contract which is funded by proceeds derived from a gift to a governmental body or a trust established for the benefit of a governmental body [M.G.L. c.30B, §1(b)(20).] 21. A contract for the towing and storage for motor vehicles. [M.G.L. c.30B, §1(b)(21).]

22. A contract to provide job-related training, educational or career development services to the employees of a governmental body. [M.G.L. c.30B, §1(b)(22).]

23. A contract pursuant to which a governmental body obtains services from a bank, as defined in section one of M.G.L. c.167, subject to the maintenance of a compensating balance. [M.G.L. c.30B, §1(b)(23).]

Compensating balance contracts are subject to the provisions of section 53F of
M.G.L. c.44, and rules established by the state Department of Revenue.
24. A contract for ambulance service by a governmental body.
[M.G.L. c.30B, §1(b)(24).] The procurement of ambulances is subject to Chapter 30B.

25. A contract to sell, lease or acquire residential, institutional, industrial or commercial real property by a public or quasi-public economic development agency or urban renewal agency engaged in the development and disposition of said real property in accordance with a plan approved by the appropriate authorizing authority. [M.G.L. c.30B, §1(b)(25).]

26. A contract for the collection of delinquent taxes or for the services of a deputy tax collector. [M.G.L. c.30B, §1(b)(26).]

27. Contracts or agreements entered into by a municipal hospital or a municipal department of health. [M.G.L. c.30B, §1(b)(27).]

28. Contracts entered into by a governmental body on behalf of a hospital owned by such governmental body where such contract is funded by expenditures from an operations account, so-called, or a special account, established pursuant to a special act that is maintained for the benefit of and designated with the name of such hospital. [M.G.L. c.30B, §1(b)(28).]

29. Contracts, agreements, or leases entered into by a municipal airport commission established under the provisions of section 51E of M.G.L. c.90, provided, however, that such contracts, agreements or leases apply to aviation uses or the sale of aviation fuel. [M.G.L. c.30B, §1(b)(29).]

30. A contract for the collection, transportation, receipt, processing, or disposal of solid waste, recyclable or compost able materials. [M.G.L. c.30B, §1(b)(30).]
A hazardous waste contract is not exempt.

31. An agreement for the purchase of photography services entered into by a public school. [M.G.L. c.30B, §1(b)(31).]

32. Energy aggregation contracts entered into by a political subdivision of the commonwealth for energy or energy related services arranged or negotiated by such subdivision on behalf of its residents. [M.G.L. c.30B, §1(b)(32).]

33. Energy contracts entered into by a city or town or group of cities or towns or political subdivisions of the commonwealth, for energy or energy related services; provided, however, that within 15 days of the signing of a contract for energy or energy related services by a city, town, political subdivision, or group of cities, towns or political subdivisions said city, town, political subdivision, or group of cities, towns or political subdivisions shall submit to the department of telecommunications and energy, the division of energy resources, and the office of the inspector general a copy of the contract and a report of the process used to execute the contract.

34. Contracts entered into between the Department of Public Health and regional emergency medical services councils pursuant to M.G.L. c.111C, §5. [M.G.L. c.30B, §1(b)(34).]


All purchases made through a collective purchasing agreement executed pursuant to M.G.L. c.22B are deemed to comply with Chapter 30B, provided that the lead jurisdiction responsible for making the procurement on behalf of the other jurisdictions complies with Chapter 30B. Similarly, purchases by a local government from a vendor pursuant to a statewide contract executed by the Operational Services Division are deemed to comply with Chapter 30B. [M.G.L. c.30B, §1(c).]

In addition, where a procurement involves the expenditure of federal assistance or contract funds, the provisions of Chapter 30B do not apply to the extent that such provisions prevent compliance with mandatory provisions of federal law and regulations. [M.G.L. c.30B, §1(d).]

The only hope is to leave Everett. It could not be more apparent that newspapers, politicians and charter committee are easily swayed with the puppet master pulling the strings. The meeting was awful and extremely disappointed with the alderman president who spoke out adamantly against the water & sewer enterprise and charter reform. Now he has backed off on both. It was revealed that his brother is the new attorney for the water & sewer fund. What perfect timing because it would have failed. Was that not the same Joe Marchese who was fuming at the building inspector about his trailer just a few weeks ago? The same Marchese's who said charter committee was compromised?

I'm not one that believes in coincidences and IMHO, there are too many going on here. I felt bad for Officer Mike Marchese, but in the back of my mind thought.........Why now? Why after all these years.....and WHY during an election year are they doing this for him? Why not last year? Why not 6 months ago? I like Mike Marchese, the President, but he's doing the exact same thing that he's complaining about. How can HE vote on a relative .............and I don't care if it's not immediate family......it's still a relative, and should have excused himself. BUT, he excuses himself from a Water/Sewer Enterprise Fund that he is against?

When did Joe Marchese become the lawyer?? That's another coincidence (and timing) that I'm not buying AT ALL. Why are we PAYING for a lawyer when we have an overpaid full time city solicitor?

Same song, another day. Guns loaded behind Dave Ragucci until the raid on his bar. Then guns loaded behind John Hanlon until he did not fire Steve Mazzie. Anyone with a brain knows how to get to Mike. The difference now is we are not talking about loose change. Pay Michael Marchese his retirement and all credits due to him is retroactive. 40 years old has another 40 years over 100 grand in salary set for life. He's been on 70% for 6 years and the 30% for the past six years is. all credits due him. Paying Joe Marchese as a city attorney aint going to be cheap. Then everyone gets their cut its how the game is played.

I think Alderman Marchese needs to learn how to run a meeting. I can't believe how unorganized these BOA meetings have been and last nights was by far the worst.

As for the other issues surrounding the alderman, it certainly appears that there are benefits to shutting your mouth.

Why does the Water Enterprise need it's own personal attorney? Is it being run like the School Department with anonymity from city government?

I could be wrong but I don't believe that Marchese was referencing his brother doing legal work for the city; I believe it was because Marchese Construction once again has a contract with the city to do water work. That was mentioned at the Finance Committee a couple of weeks ago where the Water & Sewer budget was discussed.

That said, I thought that Marchese ran a terible meeting last night. He should have known better to excuse himself before the Water Budget piece was even discussed. If he's a cousin to the other Michael Marchese; he probably shouldn't have voted on that piece either. The meeting would have been a lot shorter if not for the amount of time that Marchese spent hiding behind a pad of paper, conversing with the City Clerk. Sachetta was obviously no help either. I criticized Cornelio last week for running a crummy meeting but rumor has it that he spends some time before the meeting going over the agenda with Marchant so that at least it looks like he some idea of what's going on when the cameras are on. Marchese could take a lesson from that.

A few other questions and observations from last night.

- Does anyone know why the joint convention was cancelled last night? I thought that it would have been interesting to see what would have happened with the Parkway Overlay district piece which the Planning Board returned with a unfavorable recommendation. Anybody else see the legal notice in the Advocate for the development that wants to go in the corner of Vine and the Parkway? It says it's a laundromat.

- Has anybody seen an actual budget document for the Water & Sewer Enterprise Fund? I still don't understand why the fund was created if some of its funding is still coming the General Fund.

- So, we'll stand up for the florists and not allow permits to sell flowers to outsiders. At least until the owner of the business where the selling would have taken place complains that he won't be getting his share of the pie. So to get around it, we'll just issue the permit in the business owner's name. Nice.

- Is it really necessary to bring the City Engineer up to talk about a project before he know all of the answers about it yet?

- Why wasn't there already an ordinance in the works to handle the National Guard pay issue? One would have thought that should have been part of the recommendation coming out of committee on the piece.

I knew about Marchese Construction, which only adds fuel to the fire for me the way Mike Marchese has been acting, or I should say…keeping his mouth shut.

I don’t know why the joint convention was cancelled but I do know the city sold that land on the corner of Vine and the Parkway for $600,000.00 knowing the owner wanted to put in a laundry mat.... then implemented the Moratorium.

I’m not in favor of a laundry mat, but I thought that was VERY DISHONEST. That owner from West Roxbury is paying taxes on that land, and cant do a damn thing with it. It was disgraceful how that was handled. They took his money then said screw.

Is this the 12 million dollar budget you are looking for?

Thanks, but I've already seen that. What I'm looking for is a line item budget, much like we get for the operating budget. Comparisons to prior year's appropriations (even though this is the first year, there should be comparisons to the similiar line items in the operating budget), positions in the department and what they are being paid, etc. It seemed as if there was some other document that they were discussing at the Finance Csommittee but I haven't seen it anywhere else. And trying to get anything out of City Hall is like pulling teeth.

Ok. So I am reading the advocate this morning and I see the vote for double dipping, the only question I have is that Police or Firemen are civil service there is a state law that allows them to get their pay along with pay from the military, so now the city gets involved. I think they need to do their homework on this, I might be wrong but I don't think you can over rule state law and civil service I could be wrong

So the city increases in 9.54% are those all the citizens that the state let go or all the crip's that have moved into the city ( just wondering)

So if Cornelio ask for the Whitter School (his ward) why can't they do that for all the schools?? it's a great gesture Serg but I don't think it's fair, and I can't see the city spending more money to change the signs.

Rosa had a great idea but I wouldn't of push it to everyone, I would bring it back for Fire and Police for future hirings (which we all know will happen) they should live in Everett and carry guns with them at all times.

I vented I feel better now. Time to go patrol the city.

These crips are living all over the city. They are new, and it's like an invasion. They are also trying to recruit school children into their "Crip"

I know of one house and I live six houses away..... and we cant even keep our windows open because they are so loud at night. Even with them closed you can hear them, it's terrible. It does not take a detective to see where they are, and what they are doing. It's another big problem that the city has, and it's mainly because they will NOT crack down on these rooming and halfway houses. People like Carlo want to live up in their Taj Mahal way in the back and live in a fantasy world and think everything is wonderful. Time to get back to reality!

Do you or your neighbors contact the police when the crips are noisy? This is the first that I have heard of them being in Everett. It is simply becoming too scary to live here. Unfortunately, most of us can't sell our homes because the money we owe on our mortgage is higher than what we could sell the house for.

I've contacted the police, they came out and it quieted down. 30 minutes later, they were back at it with a spot light on in the yard at 1:30 in the morning. I called the police again, and was told they were too busy to come out for noise calls. My neighbors that live even closer, are too terrified. Ask anyone about these Crips. They are also at Walgreens and were harassing teenagers after school saying "Cum ear" "Cum Ear" I had to leave work and go pick them up. What really disturbs me is the police station is right there, but they don't "SEE" anything.

This is really sad. No one should be terrified to call the police. It is also outrageous to be told that the police were too busy to come out for noise calls. I would make it a point to let the Police Chief and the Mayor know what is happening. If nothing was done, I'd take it to the Boston newspapers.

You want to know what is REALLY sad too.....

My neighbor is in her 80s and her husband past away a few years ago so she is alone. Last summer she was hiding in the bathroom, crying, calling the police at 1am also. She lives directly across the street from them and is terrified. Her and I got together and reached out to the ward 6 Alderman, since these are absentee landlords and rooming/halfway houses causing all this trouble. His response was he was sorry, but a similar piece was already on the agenda and got killed because it was only on to hurt Stat Smith. This has nothing to do with Stat Smith (and I think Stat would agree) but I'm telling you this so you realize the mindset of what we are dealing with.

72 Prescott is transitional house that houses criminals who think they are ready to go back to society. Truth is no money to keep in jail. Friday someone trying to break in doors on Prescott St. and police caught him on Pearl St. after he hopped fences. They wear ID bracelets and city makes deals with the state and gets money. That's why nothing will ever be done.

It used to be that we all knew who our neighbors were, not anymore. It's pretty sad when you can't even feel safe in our own homes. I make sure my doors and windows are always locked. Of course, if someone wants to break in, they will not matter what we do. I believe we need more police presence in our neighborhoods. The demographics of Everett has changed and our policing needs to change with it. Everett has become much more violent over the past few years.

I also think it's a great idea for our public employees to live in the city. Mike Marchese has been trying to get this passed for quite awhile. Let's see what happens with it this time.

Absolutely, we need more police presence in the neighborhoods. They used to walk the beat all the time, but not anymore. I also do not believe in teaming up with these other cities is going to help with this type of violence that is perpetrating to extreme levels lately. I think it's going to end up being more costly in the long run, but I'd like to hear more on it. Teaming up with these other cities may help with big drug busts, or weapons busts but not the Joe Schmo walking down the streets that like to rob the elderly or home invasions. There has been an increase in home invasions too that is not being addressed. The only officer I give credit to is Larry Jedry. He really does help but one officer cant take on the whole city. There needs to be a plan....like presence in neighborhoods will be a start and the police must live in Everett. They don't care because they don't live here and that's when it started going downhill!

There's quite a difference on what was said on the collection of code enforcement fines since the mid-term speech.

I wanted to make sure, so I fast forward the video of the mid-term speech on evctonline to that part.... and at that speech..... the mayor specifically stated that.... "The Task Force has shut down 100 illegal rooming houses and code enforcement has collected over 900 thousand dollars in fines, this year alone."

No where near the numbers that were given tonight.

Item 10. Building inspector attempted to reclassify the type of business being done on that property to heavy industrial thereby putting the business in violation of the zoning in the area. Seems as if there have been ongoing issue with the City and Atty. Marchese as the city was served notice of a lawsuit on Friday. The aldermen wanted to know the details. I'm not sure about the building inspector's powers with respect to reclassification. But one certainly got the impression that Atty. Marchese thought the building inspector was overstepping his bounds by attempting a reclassification as a part of the annual inspection required to renew his license. That feeling seemed to be based on his assertion that the business that they are doing has not changed since their license was last renewed and that similiar businesses in the same zoning district had not be reclassified as part of their license renewal process.

Very interesting. After reading your last post one would think that Atty. Marchese would have the law on his side. What is good for one is good for all. Is Atty. Marchese's business near Wood Waste? I wonder if Mr Fields is attempting to change Wood Waste's classification too.

Since the BOA voted to give Atty Marchese his license, I wonder if that will make his law suit go away. I am assuming the law suit has to do with this issue. I could be wrong though.

I got the feeling that there is more to the law suit than just the license renewal. Remember, this isn't the first time in recent memory that a Marchese business has had an issue with a license renewal. The Board overrode the building inspector's recommendation on the license the last time; there was no reason to believe that they wouldn't do the same this time too. If there was any doubt, I would think that Marchese would have delayed filing his suit until after this vote so that the Board could have been included as parties in the suit as well.

You should probably watch the replay and judge for yourself though.

I watched the replay last night. I think you are probably correct. I believe I heard Atty. Marchese say this has been going on for a while and the letter from the building inspector was the final straw and pushed him into filing the law suit.

BTW, I assumed correctly on the blame game. I wonder what's up with that?

I’d say Joe Marchese is quite upset and rightfully so. Good businesses that are compliant and pay their taxes have to be in fear of reprisal??

What I found most disturbing was the fact the taxes were $8000 in 2008, and now in 2011 they are $36,000.00. This administration is driving good people out of the city.

I think Joe Marchese’s comment about the corner office being under mob rule was too kind.

Did I hear Mike Mangan say something about how copies of the proposed charter has to be mailed out to residents and implying the charter commission is out of money? How on earth can they be out of money? There were rarely any announcements in papers and they certainly did not have to pay for use of the room.

The only thing I can think of is paying that consultant, which IMHO was the biggest waste of tax payer money. Newburyport caught on and let him go. I think the commission hired him to get out of doing their research.

The questions asked of him could have easily been found by going on the internet, to a library, a city or town hall, calling elected officials in other cities, etc. I know one of the biggest reasons for hiring a consultant was to write the charter. As for the writing part, I am NOT impressed. It is a cookie cutter of the Melrose charter. Anyone can cut, paste, and create a PDF. Even MGL is online. While I'm on charter.... I think the lack of public hearings was terrible, and the way the public hearings were run was just terrible and unorganized. The 1st and last public hearings are somewhat useless. The few they had, they gave people 5 minutes to discuss the entire charter?? I'll never understand why didn't they take the charter in sections, rather than rushing through the whole thing. I hope it fails, it's so compromised that it's not even funny.

I am in favor of the unicameral form of government but, because there is a four year term for mayor in there, I will be voting against the revised Charter. Most people I speak to on the four year term for mayor are against it. Imagine the amount of damage that could be done in four years if the mayor is totally incompetent. I prefer to be able to vote them out of office in two years. If the majority of the voters approve of the job being done, he will be re-elected, thus giving him his four years or more.

From MGL Chapter 43B, Section 11:

"The city council or board of selectmen shall cause the final report of a charter commission, or a charter amendment proposed in an order which has become effective under section ten, to be printed and a copy to be distributed to each residence of one or more registered voters. Such distribution shall occur not later than two weeks before the election at which the question of adopting, revising or amending the charter is to be submitted to the voters. Additional copies of such final report or proposed amendment shall be filed with the city or town clerk for distribution to registered voters requesting the same and one such copy shall be posted in his office."

I don't believe that any money was ever budgeted by the Charter Commission to do this mailing since it was never their responsibility. And since the expense will not occur until FY'12, there would be no need to budget for it and add it to the tax levy before then. I would expect to see a line item for it under the City Council when the FY'12 budget gets presented next week.

While I largely agree that the charter review process both here and elsewhere appears to be somewhat "cookie-cutter"-ish, I believe that it can be both a good thing and a bad thing. Is there really a need to reinvent the entire wheel? If there is something that works well somewhere else, why not use it as a basis for what you're trying to do? If the charter had actually been written by members of the commission, don't you believe that some version of the same approach would have been used? The downside to using this type of approach is that it probably tends to lead to somewhat of a "closed" process. With a limited number of consultants involved in charter writing and, likely, the same people at the state level reviewing the revised charters every time, it's probably hard to convince them that there might be a better way to do something than what they are used to seeing in every charter.

From what I've heard, there were only a couple members of the charter commisssion that expressed any interest in attempting to write any of the charter themselves. Most of the members went into this thinking that they would hire a consultant to write it for them. This was not a question that we as voters knew enough to ask before we elected the commission members but I still think that we need to assume some of the "blame" for, if that's what you perceive it to be, by electing who we did to the commission. That said, I don't believe the commission could have written a charter without any type of direction or legal help. The state wasn't likely going to hold their hand during the entire process. Given the way that the city solicitor's office has been staffed for the duration of the process, it would have stretched a limited resource even thinner. And no slight to Mrs. Meijia, but she probably doesn't have all the necessary knowledge readily at hand and it probably would have taken her longer to get to the commission answers than someone who deals with these issues all of the time; it also would have taken away time from other things that she needed to be doing. Given that they were going to hire a consultant and my belief that they needed some kind of help anyways, the $10K that they spent on the consultant doesn't bother me at all; you have to break some eggs to make an omelette. I will admit though, if you asked me the same question 18 month ago, you would have gotten a totally different answer.

As for the charter itself, I am happy with it as a whole although there are parts of that I believe could have been written more simply and clearly. There's a lot of good things in it, things that this city desparately needs to do and have available. But that said, I too am having a hard time with the four year term for mayor. I had no problem with exploring it but it is the one issue that I would have liked to have seen voted on separately. Instead, we're faced with an all up or all down vote. As a result, I'm stuck on the fence on this one and probably will remain there until I actually cast my ballot in November.

I'm a bit surprised (but pleased) that the agenda got posted on the city web site as early as it did this week. My surprise is because the minutes for last Monday's CC meeting and the copy of the FY2012 budget that RVC requested at the joint convention still haven't been posted as far as I can tell.

2. The wording of this piece is somewhat confusing to me. Some grants, like the one with for the stadium, require some type of match from the city. Does the way that this is worded mean that there would be no need to come back to the city council to approve an additional appropriation if such a match is required? I hope that someone asks about that.

9. Something does need to be done about Webster Street and I guess it's either this or one-sided parking. I'm not sure what impact this will have on the City Hall Parking lot though. It's awful hard finding a parking space there sometimes and instead of being able to loop around again you'd have to go out on to Broadway and all the way around the block again. Maybe they could switch the entrance and the exit too. But, for some reason, that just doesn't seem natural to me; I think that your first inclination would be to turn into the first available opening.

15. Atty. Marchese back in front of the Board again. Wonder what will happen this time?

20. Glad to see this piece on the agenda. I'm surprised that this hasn't been more on a talking point on either of the boards lately since it was reported that Everett has the highest basic cable rates in the local area. Probably not anything that's going to come out of this that will change that since the city is in the middle of a 10 year contract with Comcast; but, it's probably a good time to start talking about what, if anything, can be done to get the city into a more favorable position when the time comes to negotiate a new cable contract.

This tells me that the current financial people we have now, like the budget director, treasurer, procurement officer (all the financial positions) are unqualified for their jobs. If the mayor wants a CFO, then what about all the other current positions? Who's getting cut...if no one does..... will there be duplicate responsibilities? I think these questions should have been answered in some type of committee before sending this to the state legislature. The way it's being sent now, is like another blank check.

I'm actually disappointed that #4 failed; it should have been sent to committee so that it could have been reviewed in detail. Wonder if the Common Council regrets it's decision from last week now?

I not disappointed though that reconsideration on the piece failed. You'd think that after the events of last week, the Mayor would have been there from the start to help shepard the piece through to a resolution more acceptable to him.

Those 5 common council members that refused to put it in committee did nothing but play games..... and it backfired on them. Not too bright, and I think it's time for those 5 to take a hike. They don't belong in city government with their game playing. It's not the place for it.

ha ha ha HA! I've gone around and around with ECTV about "certain" video that for some unforeseen reason are damaged or unavailable to upload. I'm not buying it, and I think little Miss Schiz (who thinks she's mayor) is behind it all. She doesn't get it, and could not be more obvious. I know Rosa DiFlorio lead the pack not sending it to committee because of her own reasons, and of course Cindy Sarnie does what ever she does, and the President followed along which was disappointing to me because I started to think he wasn't doing that bad. Rosa was getting very upset about sending it to committee and I'm not sure why. This was not something to get upset about. People had questions and wanted those questions answered. Sending that to committee would have been the obvious thing to do. Actually, it should have started there. NOT sending it, made no sense.

Sorry, cant remember the others. I'm "guessing" Rodriguez and maybe Adam Ragucci. I have a MAJOR problem with Rodriguez voting on these items anyway that his WIFE drafts. BIG TIME ethical issue. I've never seen him ONCE question what is out there, or vote against it.

Actually, the original motion to send the piece to committee failed 5 to 9 according to last week's Advocate. So there were nine of them who voted against it.

I can't remember exactly who voted for and against it either. But I think that the names that Tails listed above are probably right. I believe that it would be a safe bet to add Marcus and Ranieri to that list as well. One name that I'd usually expect to vote with the Mayor, D.J. Napolitano, was listed in the Advocate as being the only other councilor along with Peter Napolitano who voted against sending the piece to the Legislature. So I'm not sure that adding him to the list of those who voted against sending the piece to committee would make any sense without some further proof.

I've re-thought that and there is one thing that they could possibly do. They could vote not to accept the donations, no matter what account they are submitted to. I seriously doubt that would ever happen though.

I thought that it was something that needed to be done ASAP.) or finally redoing the entire road (If so, where's that money coming from?) Depending on the answers to the previous questions, I guess the Stabilization Account could be an appropriate source for the funding. I'd be more comfortable with choosing a funding source if the status of this year's free cash was known first though.

I believe that it would be a step backwards to "de-empower" the traffic commission. However, I do believe that steps need to be taken to open up the process though. Their agendas and meeting reports need to be published on a timely and changes implemented by the commission need to communicated much better to the general public. Perhaps their meetings should be televised too.

Piecemeal implementation of a 24/7 parking ban doesn't really seem to make sense though; it would seem to just move the problems from one street to another and making it really confusing for people to know where and where not they can park. Of course, the flip side is that a 24/7 parking ban would mean increased staffing in the parking office unless the intention is to have the police do the addition enforcement; I think that we all know that would not work out in the long run. I feel that even the piecemeal approach, if extended to enough neighborhoods, would also require additional staffing somewhere down the line too.

I agree about the fountain. It's going up, and that's it. I suppose technically the donations can get denied but as you stated, that will never happen. The BOA should accept this and move on without discussion. We had enough grandstanding, cross-debates, accusations and last but certainly NOT least....BOASTING over this memorial fountain. I for one have had enough.

I don't recall planning board members being appointed by both councils, but sometimes the rules apply, and sometimes they don't. I knew there was a problem with the Water's Ave Project so I'm sure the new appointee is the correction to get that moving forward.

I was against item 11 before, but changed my mind on that. I think public safety employees should work in the city they live, and I also think it should be for teachers too. Not sure how the residency requirement should be worded, but as long as the Everett resident has the qualifications, they should be hired first.

There shall be a planning board consisting of five (5) members who shall be appointed by the mayor, subject to confirmation by the city council."

Tonight, I hope that someone brings up the other points that I mentioned a couple of weeks ago about planning appointments tonight, i.e., that there are three members of the board that have expired appointments and a fouurth was never confirmed by the Common Council.

It's a shame that the two projects on Beacham Street didn't line up better to provide an opportunity to save a bit of money. Oh well.

It seemed to me as if once again, in the finest tradition of Everett politics, that the Beacham Street project is being shoved down the City Council's throat. Don't get me wrong. Beacham Street needs to redone. But the BOA was asked to approve the design money in order to qualify for a grant whose application deadline would have already passed if not for a natural disaster. And if I heard the gentleman correctly, the deadline was the 16th, before the Common Council will vote on the appropriation. And one of the major conditions for receiving the grant is to display that the project will be ready for the next construction season? With plans not even started, how likely is that to convince the powers that be that the project will be ready for next spring? And when the city applies for grants, isn't a vote of City Council required to authorize the Administration to do so? That was the case with Air Force Road (BOA – 06/14/2010, CC – 06/21/2010) and more recently with the Shute Library ( BOA - 05/23/2011, CC – 06/06/2011). This all seems very rushed to me. But, as I'm to willing to admit, what do I know?

It's been posted 48 business hours in advance for as long as I can remember. This is a very easy thing to do and we know the agendas are final by Thursday. It "appears" that every time there's a controversial issue, the agendas are never posted on-time, just like the ECTV videos that have a strange way of either disappearing or have technical difficulties.

I guess I'll have to wait to see if there's anything that can be controversial this evening.

Call it what you will, as suspected...just by skimming the agenda, I see a few controversial items on particularly 10, 11, 21 and 23.

It's going to be interesting to see just how much the charter commission has spent and spent on that consultant. Nothing personal against the man but after seeing the proposed charter, it's rather evident that it was a cut and paste from the Melrose and Holyoke Charters. Anyone could have done that and with MGL online, it could have been researched from the commissioners that were willing to put in the effort. If there was a legal opinion needed, we were told we had the city solicitor. I'm curious how much was spent there.

What's this about outside legal council on item 23? The mayor stated everything was done in-house and why are we paying for 3 attorneys?

Looks like a long night for the alderman.

It is obvious that Alderman Marchese has a problem with the new charter. That is certainly his right. But just as a lot of us don't believe that city meetings are the place for campaigns for elected offices to play out, I don't believe that the Council chambers are the proper place for anyone to be expressing their feelings about what is now a political issue that will be decided by the voters in November. That's a whole lot different from asking the Charter Commission how they spent the money that they were appropriated.

I have no clue why a representative of the Charter Commission didn't appear at the meeting. But what I do know is that according to MGL, Chapter 43B, Section 8, and also from what I have posted before, the Charter Commission had to turn over any remaining funds and document their expenses back in June. Why is this an issue now?

I guess it was the signs. I have confirmed that a committee was set up. I'm sure that the City Clerk knows that. Why didn't he speak up when Alderman Van Campen mentioned he had to believe that private funds had been used for the signs? It would not have been absolute proof that nothing funny was going on but it would have been more evidence that it is very likely that things are being done correctly.

And if Alderman Marchese's real main concern was when this "crap" was going to be published, why was his agenda item so specific that it didn't include that issue? And if he had been paying attention, he would have known, again under MGL, it is actually the City Council's responsibility to publish and distribute the final report and can therefore control when it is mailed to the voters. Again, why did nobody speak up on that? Are they afraid of Marchese?

I have heard that Everett's Charter Commission has stayed very involved in the final report distribution process, which is above and beyond what they are required to do under MGL. But by doing this, it's likely to avoid any snafus from occuring. That's something that can happen very easily; if you've got a little time to kill, do a little research on what's happening in Holyoke with the final distribution of their new charter. We like to think "Only in Everett" but crazy things seem to happen everywhere.

There are questions I hope get asked. I know this is a savings for municipalities, but will this compensate for local aid cuts?

How much per week is the actually savings to the employee…compared to the increase in co-pay, medications and deductibles that employees will have to pay? Any cost savings to the city should also be applied to overhead/fixed costs that we are constantly hearing about at budget time. I’d like to see a promise about that, and not have the administration use this savings as an excuse to spend spend spend however they want. I’m not sure that this will go over well with unions either. I’m not sure, but I think they lose veto power, but still have a say. That’s not a consolation to the unions or employees. I do understand that unions can be very difficult to negotiate with.

I question the retiree aspect of this. I have to look it up but I believe retirees will be forced on Medicare, which a National Health Plan for elderly and disabled. Although it all sounds good, and it very well could be a good thing I kinda have mixed emotions on it.

I hear you but not all doctors accept medicare patients and there are also cut off points. Medicare does not pay their bills accurately, so the doctors do not want to deal. When you've put in so many years of work, I just do not feel it's fair. People that are lifetime workers should have the best possible care but that seems to be going to people that Obama open the flood gates too instead!

Why on earth did they send him to answer the questions? He sounds like a total idiot. Is he?

I have a problem with members of the Common Council & Board of Alderman expressing their opinion about the charter question during meetings. It's natural for them to disagree with eliminating their position but I don't think they should be doing it on TV.

They're all there to represent the citizens of this city & until it's voted on, their opinion is not necessarily the opinion of their constituents.

I am really surprised with Mr Sansone. He is a retired principal of one of our former elementary schools. You would have thought he could answer some very simple questions. What a disgrace.

I also have a problem with our elected officials giving there opinion on a ballot issue during a meeting. Outside of city hall is fine.

What I got out of Sansone is "the recall" is Bull ****!

If a mayor gets reelected do they still have to wait 6 months and collect 250 signatures to have a special election costing the taxpayers at minimum 30 grand to have a special election? All I have to say if it's the current mayor... heaven help any person that starts that kind of petition.

There's going to be no cost saving here in the long run. Salaries will increase in replacement of the health insurance....the members will be over worked since those 11 are going to have to pick up the slack that 25 others did... plus have their own jobs and family. We WILL have less representation I don't care how Sansone spins it. I''m not being mean, but he was the worst speaker to speak on charter. I could not understand a word he said and he had to quote directly from the charter. He did not even know about the changes. I don't trust this group and it's too much drastic changes all at once. If this does not pass, the 4-year term is what blew it and this farce of a recall.

We have a recall now and that's a 2 year term for mayor. We are going to the polls every two years anyway so the only thing I see in a recall is A LOT of time, expense to the taxpayer and concern for the safety of the person that starts a recall. This is not cost effective at all and would be the worse thing in this city if charter passes. I heard from numerous people that the Chairman of the Charter Commission, the consultant they hired had private meetings with the mayor, and the superintendent of schools. This has become too political and these parties involved are to blame! It was those people that started it with the signs (Vote YES on Charter) I don't blame that Vote NO on Charter committee for starting one up too. But the Vote YES started it first..... and this whole thing has become bogus and deceptive. Big Vote NO here.

The people who gain are the mayor and the superintendent.

I know there was more than one meeting with the mayor, Schlosberg and the Consultant. They meet.....and ask what they want. The mayor wants a 4 year term and the superintendent wants the mayor to not be a voting member of the school committee. That's exactly how it played out on the taxpayers dime. 10 grand to pay this guy for the commission to get out of doing their own research. All the questions asked of him could easily have been found online or contacting elected officials. Our proposed Charter is almost an exact replica of Melrose. It's a simple cut and paste.....change Melrose to Everett, and he gets paid 10 grand for that? He was supposed to write "our "charter, and what was best for this city, not copy other cites charters. Newburyport dumped him and I wish we followed their lead. In my opinion, it's a misuse of taxpayer dollars so the Grand Poobah's get what they want and basically screw everyone else. it's a real shame because this had the potential to do something good in this city, but all the wrong people were elected... somehow......

What really stinks is that it was time! The current charter doesn't do the job anymore & needs to be fixed.

What makes it worse is that so many of our elected officials are there for their benefit, not ours....... I hoped that a smaller group would mean higher quality but it's certainly not looking good!

I really believe it doesn't matter if it's twenty-five or eleven. They will still be elected by popularity and not qualifications. No matter which way the charter vote goes, that will not change.

I feel there are other issues in there that are even more important. One is, "The mayor would have a number of new responsibilities, most notably in the area of city finances." That one sentence scares the heck out of me...

It's on page 2 of the Charter Booklet under the subheading Mayor.

Yes, that sentence scared me as well but when I read further, I tied it to section 3-5 (a) & that stopped the panic. The reason I did that was because it was the only other place I saw anything referring to city finances.

In the interest of disclosure I have a friend on the Charter Commission. That being said I don't believe anyone in their right mind will want to serve on any of these commissions in the future. I mean, they get ELECTED. If there were better canidates who were they? Why werent they voted in? We have local buisness owners, City Council members past and present, a former mayor ( who by the way is no friend of the current administration )They put in a large number of hours and attend numerous meetings to discuss the issues, spending time away from their families. They don't get paid a thin dime. And they get bashed up one side and down the other for their trouble. I concede the result for some people may be a little less than perfect but cut them some slack.

Yes, a lot of time was spent by these people however it appears the commission may have been compromised by the current administration. We know John Hanlon probably didn't play but there are others that very likely did. Lattanzi is insured through his wife who works in Carlos office. Joe Hickey owes his job to Carlo. Sansone was a school principal so Freddie probably has him wrapped up. Schlosberg will go to the highest bidder & Marcus is in Carlo's pocket. Isn't there a Schiavo in Carlos office as well? I don't know Martin Long or Bono but they would be the minority vote so they lose...........

If I remember correctly, there was quite a list of people running for the Charter Commission. I think what happened, it came down to name recognition. The people who wanted to do it who weren't connected anywhere really didn't have a shot.

Justme, Dorothy Martin Long used to be on the School Committee some years back. I don't know Mr Bono.

That's what I said earlier massdee............ There were a lot of "unknown" people on the ballot & they're still unknown. Amazingly (to me anyway), people voted for names they recognized like a one term, incompetent mayor & a former councilman/city employee who knows everything about everything.

It's obviously a no win situation. If people don't know you, they won't vote for you............ Remember the Eddie Murphy movie about the crook who was elected to the senate because he had the same name as a decease politician? That's probably the only way we could have gotten anyone without an agenda or connection on the commission!

Hmm. I don't often get called obtuse. I'm thick skinned though and don't mind taking a few elbows when I'm playing ball, lol. This seems to be going around in circles a little bit but maybe people that were "unknown" should have campaigned a little harder and made themselves known. That is how it works. Everyone is unknown at one time before the become sombody. In any event, in the end, it all comes back to the voters. It is THEIR responsibility to do their due diligence. They elected this Charter Commission. If the voters didnt care enough to analyze all the candidates properly and the other unknown candidates didnt bother to campaign hard enough and give people a solid alternative then who's to blame? I'll even concede you have a point that SOME of the members may be political players. I'm just a little bothered by the broad brush being used every time the Charter Commission is brought up becuase I know some of them had nothing but the best intentions and gave their time because they actually care about the City of Everett and had a sense of civic duty.

You may be right about the unknowns not campaigning enough but it's a catch 22. If they knew how to campaign, they probably would be politically connected in some form or fashion.

Either way, I'll gladly acknowledge that there was a lot of time involved with no compensation. I'll further state that I do believe the intention of most committee members was to do something good for the city.

Unfortunately, I seriously doubt they were ever able to come together as a cohesive group. I imagine the loudest, most stubborn & determined of them fought, argued & literally held their breath like a 3 year old until they got their way!

It certainly is Tails but the City Council gets to set the rules for it:

From Section 2-6 (c)(i) of the new charter:

"All regular meetings of the city council shall provide for a period of public comment, provided however, the city council may promulgate rules that regulate such period of public comment as deemed appropriate."

The real question is when do the new charter changes begin to take effect?

From Section 10-6 (12) of the new charter:

"So much of this charter as is possible shall take effect following its adoption by the voters."

I'm glad that public comment is being addressed so quickly; I know that there are other sections of the new charter that I'd like to see implemented ASAP too.

Who gets to decide that? From Section 10-6 (11) of the new charter:

"The mayor and the board of aldermen and common council, in office at time this charter is adopted, and the mayor and successor city council elected pursuant to this charter, shall have the authority to adopt measures that clarify, confirm, or extend any of the transitional provisions in order that such transition may be made in the most expeditious manner possible."

I thought 5 police officers were supposed to get sworn in? What happened to the other 3 positions? These positions are federally funded.

What happens to that federal money and the 3 positions if people walked away?

As for the mayor, you are right. It's one of the very few times he shows up for a meeting.

He needed to knock that chip off his shoulder at the MRF meeting....and.....put his phone down for 5 freaken minutes to concentrate or at least pretend to care! There should be no cell phones during a meeting.

He was clearly agitated at people asking questions... yelling out.....what did they do before? The questions that get asked from councilors are not necessarily from them, but from their constituents. I don't care if you repeat yourself year after year.....new people move in and the process should be explained from A to Z.

4. Looks like the FY'12 Water and Sewer rates needed to be adjusted to support the FY'12 expenses of the enterprise fund. Does this deficit include the additional income that was supposed to be raised by replacing the commercial water meters. Exactly where is that project? And what additional funds (if any) have been raised by replacing these meters? As I stated in the Common Council thread last week, supporting the enterprise fund from money raised by other means defeats the stated purpose of what the enterprise fund was supposed to be all about.

2. I think that the City Council needs to post the rules for public comment somewhere, in the papers, on the city web site or both. We seem to get a different intereptation of the rule every week. Personally, I think that comments on only what's on the agenda makes sense; but if there was any time remaining in the ten minute period once all agenda comments were made, I wouldn't be against using that remaining time for other comments.

4. Well, what was said about this item makes a lot of sense. Given that the proceeds of water bills being paid for prior years have to be credited to the general fund rather than the enterprise fund, there should be some free cash available next year to make up for at least some of the free cash that may be needed this year to make the enterprise fund whole this fiscal year. But I guess that the question that I still have is this: why didn't city government understand what the impacts of this change would be before they approved and implemented it?

8. I agree with Alderman DiPerri. It wasn't really truthful to bury the error in transferring Auto Hire money to the new department in a union settlement transfer. Everybody makes mistakes; just own up to them.

10. So I guess the the extra buyback money must be for retroactive buybacks. But $97,000 seems to be a lot given the percentages of the raises that the City Solicitor quoted. But who knows what other terms may be in the contract and how many days were paid out over the period. BTW, the way that this item appears on the calendar would make you believe that these transfers are only for an FY12 settlement. This just an example of how these items should probably be written with more specifics since public comment on the agenda is now available.

Cassidy as a Patrolman to the City of Everett's Police Department.

I heard he's not an Everett resident and lives far out and even past the 10 mile radius. Did we not just pass a residency ordinance? I know it's not 2012 but it's cutting it kinda close and is a slap in the face to all the work that was done. I find it very hard to believe there was no one closer that was available and had the same training.
