I see a lot of people quoting MGL....Im wondering who the lawyer is among us to ensure that the chapter/section being sited is relevant to your argument. I'm honestly having difficulty finding a section that says the appointment has to be done immediately, as previously stated. |

It seems that the folks up at St. Theresa's replaced their sign because it was "old and ragged"? Where did the first sign come from? Maybe there is property one does not wish to posess. Maybe it relates to FFF and his legal problems. |

Very disheartening story on the front page of the Independent this week. The DCR came in this week and pulled out all of the improvements that Mr. Brandano had made in the median strip at the top of lower Broadway. It happened because Mr. Brandano refused to sign an "Adopt a Highway" agreement that he stated would have let him do little more there than cut the grass there. This happened even though he had previously received letters from the DCR praising his efforts. Mr Brandano felt that all of this happened because of an incident last fall when someone he described as current city department head approached him about putting a campaign sign in front of his house. He refused because he stated that he has never done that. The article stated that the Independent had asked for a comment from the mayor's office and the DCR but neither had responded by publication time. |

That's too bad. That area was a mess and he made it look nice and friendly. The only thing I don't understand is...isn't that city property? From what I know, he donated his time and efforts to make the area look nice. That did not cost the city anything. I also don't think you can put a political sign on city owned property..but I could be wrong. |

Thanks for the clarification. I hate those lawn signs on peoples houses. They look trashy. I wouldn't want one either. Bumper stickers are okay but the lawn signs fall over because of weather, I have seen kids throw rocks at them, I just don't like them and when driving through other cities and towns, I have to say Everett has the most during every election. I did not have a lawn sign but I supported a candidate. I wonder what DCR is going to do to pretty up that property? The BOA is always complaining about the businesses on the parkway that have to plant flowers, etc...the same should be done there. That's the Everett/Boston line. Everett lost a good worker there, Mr. Brandano. I saw him there in the summers every morning and evening working. |

Honestly....I could do without his truck blocking traffic at the rotary every morning in the summer. It's hard enough to get through there without his truck taking up half a lane. And while it was nice to see the flowers making it look pretty, the vegetable garden, plastic deer and owls were a bit much. |

I never saw his truck block any lanes. As for the statues they could have been a little much but so what, it was better than nothing and he did it all for free. I doubt any landscape business will do it for free. He used to go and hand water those flowers and plants. I'm sorry but that's the type of people you like seeing and he reminded me of the old Everett...people giving to the community like that. If any one else does it, it will be for the almighty buck. |

Tails...I'm in agreement with you, I think it is good to see someone donating their time, energy and money like he has done.....but....the man had a vegetable garden growing in the island, that is a bit much. To me, he was treating it more as an extension of his own property rather than a piece of the cities land he was voluntarilly keeping up. |

No good deed goes unpunished By Augustine Parziale
Most public officials and local residents will tell you that it's difficult, if not impossible, to get officials from the state Department of Recreation and Conservation (DCR) to respond to requests that they maintain the property they own in the city in a timely manner.
Yet the DCR apparently found plenty of time this week to dismantle the improvements to the Sweetser Circle Rotary that a local resident spent nearly a decade building and maintaing, at no cost to the state or city.
Everett resident Richard Brandano has received numerous citations, awards and recognitions for the work he has done beautifying the Sweetser Circle Rotary that is located just across the street from his Bow Street home over the years.
Now the local landscape artist is heartbroken after the DCR spent the day on Monday tearing out the trees, plants and ornaments that he installed and maintained on his own dime for roughly nine years. "I feel like someone ripped my stomach out," Brandano said this week while surveying the aftermath. "They just came in today [Monday, March 24] with a front end loader and tore everything out."
Brandano had received permission to beautify the area from the old Metropolitan District Commission(MDC), the state agency that later became the DCR, and he had done so to great acclaim.
Brandano had received numerous citations from previous mayoral administrations and the DCR itself over the years, even earning the key to the city and the recognition of several media outlets.
However, in February of this year, Brandano received a letter DCR Deputy Commissioner of Operations Jack Murray stating he was violating the agency's "adopt a rotary" program.
According to the letter, Brandano was cited as being in non-compliance for failing to sign an agreement to maintain the area ta his own expense. That agreement also included a stipulation that he would promise not to plant any trees or plants or add any ornaments to the rotary that might obstruct the view of traffic. "What they basically wanted me to agree to is just mow the lawn," Brandano said, " I told them that I had permission to put all of that stuff up there and they told me that was when it was the MDC. Now, it's the DCR.
However, Brandano also has a letter dated June 13, 2005 from then-DCR Acting North Region Director Bill Morrissey, thanking him for all the work he'd done over the years in maintaing the area.
Brandano said this week that he believes the sudden change of heart from the state agency stems from a dispute with a current city department head over Brandano's refusal to place a campaign sign in front of his home last year. "I told them that I don't do that." Brandano said, "I've never put anyone's signs up; I try not to get involved. I never did this [maintaing the rotary] for myself or for the politicians. I did this for our fallen heroes, and so that the people would have something nice to look at."
Brandano now believes that the DCR undid all of his work at the behest of the city employee.
Calls to both the DCR and Mayor Carlo DeMaria's office weren't returned in time for publication.
Over the years, Brandano has done thousands of dollars' worth of work in the area, including installing a full sprinkler system.
As upset as he is to see his years of hard work go up in smoke, Brandano said he is equally sad and mystified by the entire ordeal. "With all of the problems we have in this city; the potholes, the broken bridges, the streetlights that don't work and all that, the thing that they go after is what I did to improve the area," Brandano said, " I just don't understand it."

Thanks Massdee.. I don't always get the Independent. That is such a sad story. I can not believe how petty that is to pick on him, a person trying to do good for his community. I'm a firm believer is what goes around comes around and the time will come for the people responsible for these despicable actions. |

You can voice your concerns to the Governor since he is the top of DCR along with Lt. Governor Tim Murray and let your voice be heard. They probably are not aware of this. This week we reached a sad milestone in the war with Iraq. We have poverty and families without health insurance. Right where the DCR pulled this mans property out we have roads being torn up from overweight trucking. This is an injustice that was done. To do nothing and not speak out would be another injustice to a man that loved his community and wanted to help out a little even if it was to put a smile on a child’s face.
