If the deal is that she give certain testimony, and she doesn't give that testimony, then the deal is off.

It's going to be interesting. Let's see what the noble members of the School Committee do tomorrow night; let's see if they did the right thing and told her she'd have to turn in her resignation or if they have the chops to dismiss her and be public about it. Let's see if they finally have the castinets to do the right thing.

But I'm not betting my mortgage payment on it.

School committee and "castinets" are words not usually found in the same sentence, Lisabeth. They would first have to get them back from Fred, who snips them off right after they're inaugurated. Or beforehand, if he paid for their ads and stuff.

I think Lisa is correct I checked the coputer on the Hiller report(nothing there) so I called channel 7 news and they stated to me that it was front page news and it happen in the year 1999 and he won back his pension along with the former state rep. from Medford Hurley

I found this link to a website that reference a couple of Boston Herald articles that reported on a widespread pension abuse scandal, and McGonigle was part of that. Evidently, a retired judge "advised" the state retirement board that they should pay McGonigle his pension.

According to these articles, AG Reilly was supposed to be "fixing" the problem, but I've not yet found any follow up to it. I'll keep looking, but the bottom line, at least according to this article, is that a public employee convicted of a felony committed in the course of performing their jobs are not entitled to receive their pension benefits. That McGonigle was able to skirt around this, at least for a time, doesn't mean DeFeo is going to be allowed to do the same thing. Again, this is something that should be watched very closely. The sad thing is that, at the end of the day, I get the feeling that most people don't really care.

Well, I stand corrected. However, it would appear that there is no real loophole, just an interpretation by a politically hard-wired judge. The State Supreme Court already decided that the forfeiture law was constitutional.

Well,well,well..I get back from vacation and this happened? Missed you all, H1 say hi to the pup for me, please.

Did anyone catch the SC meeting last nite? Are they finally going to bounce Defeo? Probably not. Then again, they could always rehire her as a consultant, like everyone else. Could she get her pension back as a consultant? Wouldn't that make her a new hire?

I wish everyone PEACE and LOVE this season.

Masterful - welcome back!! To answer your question about pension benefits and being a consultant - there aren't any medical or pension benefits available to a consultant. But you know, it wouldn't surprise me if Fred tried to pull that stuff!!!

I caught the re-airing at 10pm last night. They do their "Fred" jig, and then they clap for banieweicz (spelling - sorry) and the other clown that's leaving and then they - get this - go into executive session to strategize with the legal advisor, and then come back and adjourn without taking any votes on anything. beautiful.

Well . . . I'm certainly not one to defend the School Committee, but I think by law, whenever a personnel matter is to be discussed, they're required to go into Executive Session because under employment law, DeFeo is entitled to certain rights of privacy.

Also . . . and again, this isn't a defense of those yahoos on the School Committee. . . but technically, it's up to the Superintendent to fire her. He has hiring/firing privileges over employees of the School Department. I believe this is covered under School Ed Reform. The School Committee's only "hiring/firing privileges" are in the appointment or discharge of the Superintendent, and we've all seen where they stand on that subject.
