The Everett Planning Board will conduct a public hearing on Monday, July 28 at 7:30pm in the Keverian Room, 3rd floor, City Hall on whether or not to recommend to the City Council that part of Fourth Street be discontinued.
The part of Fourth Street to be discontinued 551.92 feet long by 50 feet wide, containing 27,596 square feet.
I have two questions.
1) Can we write to the planning board before hand with information?
2) I know who's on the planning board. Are their names public information and can we list them for people to contact/write?
I don’t want to burden anyone but we don’t even know what’s in that preliminary injunction and we should before anyone votes no/yes to discontinue a portion of Fourth Street.

The names of the people on the planning board IS public information.
Of course, Fourth Street really doesn't have anything to do with the Wood Waste PI, but it has everything to do with William Thibeault, who owns Wood Waste. My personal opinion is that I would not like to see anything go forward until we have some resolution of the Wood Waste issue. Mr Rossi told the city council a month ago that the debris would begin to be removed and shipped to the mid-west if Newburyport didn't allow the increased trucking. Newburyport voted against it and the mountain down on Boston Street appears to be growing larger. "I" would give Mr Thibeault nothing until he fell into compliance down on Boston Street. |

The city's web site does not contain much information about who the appointees to the various boards are. The planning board consists of five members each serving five year terms, one appointment expiring each year according to section 2-191 of the city's revised ordinances. According to the legal notice for the public hearing, the chairman of the planning board is Fredrick Cafasso; Dawn Colameta is the board's clerk. According to revised ordinance 2-193, the board annually elects a chairman and a clerk from its own members, so that's two of the members.
So I tried to locate other members of the board by going thru BOA agendas looking for appointments to the planning board. Agendas were first put online at the beginning of 2007, so I wasn't going to find all the members but I thought that I might find a couple. The only planning board appointment that I could find in this time frame was Stephen J. White. His appointment was approved by the BOA at the March 26, 2007 to fill a term expiring March 2008. I don't understand why there wasn't an appointment for the term expiring in 2007 and why nothing has been done to fill the term that expired this year. The obvious question is what happens when an expired term is not addressed? I have no idea what the answer is and don't really want to speculate about it.

They are not usually televised, so I don't expect this one to be. |

If it's open to the public I have every right to be there. Unfortunately, it's not a public hearing and fourth street really does not pertain to my issues. I'm much more concerned about lower Broadway. The discontinuance of fourth street will affect the abutters more. They are being pushed out and I feel bad for them. I mean, what's next? Will they take their properties by eminent domain just so Thibeault can have access to the parkway? That's what it's coming down too and it's getting sickening. Instead of forcing Thibeault to get his ass in compliance and stop the suffering and the burden to the abutters, the neighbors, Stop & Shop employees who are getting sick.... we have an administration that picks the most convenient time to put these issues on the agenda. When the city council is out for the summer and a lot of them where on vacation last week......the same week the Mayor decided to put this announcement in the Advocate ONLY. Thibeault still is in non-compliance with Wood Waste, there is a preliminary injunction against Wood Waste that we are not privy to but Thibeault has the right to go in front of the planning board? Where the heck is the justice there and it's not Thibeault that will be going to the polls and it wasnt Thibeault who went to the polls when Mayor DeMaria was elected and he is arrogantly forgetting that fact. |

I think it's important that when you have a Board of Appeals hearing or a Planning Board Hearing and it's listed on the calendar.....
You must be logged in to see this link.
that you should be able to see the agenda. Right now when you click on Planning Board/Board of Appeals....the only thing that comes up is the Keverian Room. It does not have to be a long agenda, but just a few words what it's in reference too. |

Just an FYI......that it was brought to my attention that the listing in the Advocate for the Planning Board Meeting ,on July 28th on the discontinuance of 4th street, says 7:30pm...... and the cities website says 7:00pm. I would assume it's 7:00pm and not 7:30pm per the advocate. |

Actually, if I understand the rules correctly, the public hearing needs to take place at the time specified in the legal advertising. Otherwise, the public hearing could be invalidated. It is possible though that the planning board has other items on its agenda that it could be planning to deal with before the public hearing.

I agree, the planning board will probably send it to the city council with a favorable recommendation. I also think this will pass in the CC and BOA with no problem. This will be the first step or maybe the last step, to a resolution of a long standing issue. |

Was forth street “included” in the “original” purchase and sale of the old city yards and did the city council approve that? I just don't see what the sale of the city yards has to do with fourth street and why the fourth street "issue" has to be first. |

I could be wrong, but my understanding is that Fourth Street was part of the original package. If true, then it's time for the city to hold up it's end of the bargain.
Can anyone tell me if I have that correct? |
