RE: Lower Broadway and Resort Casino Zoning Districts
To the Members of the Common Council and the Board of Aldermen:
My consulting firm was retained by the Mayor’s Office to prepare amendments to the Zoning Ordinance under the direction of the City, working in coordination with senior staff including the Department of Planning and Development, Building Department, City Solicitor’s office and the Mayor’s Office, and with legal counsel Kopelman and Paige, P.C. A summary of the draft zoning proposal will be presented to the City Council Joint Convention scheduled for Monday, August 19, 2013.
If so ordered by the Council that evening, draft zoning and map amendments will be placed on file for public inspection late next week, and advertised for consideration at a Planning Board public hearing to begin on September 9, 2013.
The zoning amendments would accomplish two primary objectives:
1. Modify the Zoning Map to provide for Commercial, Employment, Mixed-Use and Residential zoning districts in the Lower Broadway area, allowing new private investment in this location based on the vision set forth in the Lower Broadway Master Plan. The existing zoning is almost entirely industrial.

This memo and the draft zoning map, attached, are provided to summarize the draft zoning proposal in preparation for the meeting this Monday. Zoning Framework, Lower Broadway District
The Lower Broadway Master Plan prepared by Sasaki Associates, working with the City of Everett through a substantial public process, provides the basis of the proposed zoning map. A Lower Broadway District (“LBD”) is proposed, including zoning subdistricts organized based on the land use objectives in the Future Land Use Plan, pictured here.
Key policy elements of the proposed zoning would include:
#8227; Commercial, Employment and Mixed-Use Zoning closer to the Mystic River, transitioning to primarily Residential zoning north of Beacham Street.
#8227; Increased allowable building height, with allowances greater in Commercial and Mixed-Use district transitioning to lower allowed heights in residential areas.
#8227; Design Standards to provide developers clear direction regarding the City’s objectives for development in this location, and to provide the Approving Authority a framework for project permitting.
#8227; Incentives, such as height and density bonuses, for projects providing additional public benefits such as improvements to sidewalks and parks, public infrastructure improvements, and structured parking (as opposed to surface lots). Resort Casino Overlay District.
In addition to the LBD District, a Resort Casino Overlay District (“RCOD”) would be proposed to provide for a Category 1 gaming establishment along the Mystic River waterfront. It would provide for Expedited Permitting pursuant to G.L. c.43D, and establish specific performance standards to provide for a clear permitting framework.
PAGE 2 Drafting of both proposed Zoning Districts has proceeded in coordination to ensure that the proposals are mutually compatible, and to craft LBD zoning that will facilitate private investment that advances the vision and objectives of the Lower Broadway Master Plan.
At the Joint Convention, the draft zoning proposal will be presented in more detail, and I will be available for questions and discussion. The Director of Planning and Development will ask the Council’s direction regarding whether to refer the zoning proposal to the Planning Board for public hearing. I am happy to be working with the Mayor’s Office and the City of Everett on this important initiative and look forward to meeting with you on Monday. Another shining moment in Everett government last night. While I'm feeling a little more comfortable with the idea of a redevelopment authority, I still need some time to digest all this and do some more research. Still don't know where the money for it is going to come from though. I think that sending the pieces to committee was the appropriate thing to do.
I don't think that it was absolutely necessary to send the zoning change to the planning board either at this point. If the city council wasn't at least generally in agreement with the ordinance that is being proposed, what's the point? But since they didn't even receive a copy of it, how would they know?
I guess the administration just believes that everything they propose should just be accepted without question. A redevelopment authority, in a lot of peoples minds, can carry negative connotations. If it is something different these days, it's the administration's responsibility to educate the citizens and prove it to them. But they've never understood that and after the relative ease with which they got the casino passed, it's actually somewhat understandable. But it's going to be different animal when you are talking about fears of people losing their homes or businesses. And the administration needs to understand that. |

Mayor DeMaria talks out of both sides of his mouth. First he says no one’s property is being taken by eminent domain THEN he says the property will be taken with the “city council approved urban renewal plan”.
Who does he think he’s kidding, that’s just semantics and trying to throw the city council under a bus if/when it blows up in his face.
I have to ask, why is the current city council and mayor trying to create an entity for a future city council and possibly a new mayor?
The bottom line is property will be taken, one way or another. He’s trying to make it cheaper for Wynn. I think we all know why.
Why does the MBTA need the City of Everett to create a “Redevelopment Authority” to give us a small piece of land? And, the mayor calls that a “gift” I don’t think so…..
The part that really bothers me is the City of Everett is investing so much time/energy and money for a casino that may or may not come to Everett. I find that very irresponsible and a disservice to all residents. |

There is no reason to rush things. After the results of the November election we will know who is representing us. They are the ones who will need to deal with it. Carlo is using the casino as a campaign aide. He even tells residents that if they don't vote for him, they won't be able to get casino jobs or that the casino won't come to Everett. Always misleading the voters. And did you see how he is unable to control his anger. That scares me because it gets worse every time he encounters something that doesn't go his way. And the way he jumps up to the podium without being recognized. Unfortunately, the presidents of the boards don't use their authority and tell him that he can't speak unless recognized or asked to come before the BOA or CC by one of their members. If he gets in for fours years, how much worse could he become. Hope people think long and hard when they get out to vote. |

The quote that the mayor usurped the podium to read last night said that the creation of a Redevelopment Authority is the "most expeditious" way to acquire the land for Wynn. So that means that there are others ways to accomplish this. Why not explore them?
I don't get why the city has to be so involved in a development that is not guaranteed to come here yet. I know that the host agreement includes some language in it the city has to do whatever it can to help Wynn secure the license. But this does seem to be putting the cart in front of the horse. What would the Redevelopment Authority do with the land if Wynn doesn't get the license? Is it "clean" land? Or would the Redevelopment Authority become responsible for that? |

#8 - Can't imagine that Alderman Van Campen is too happy about this. Though Councilor DiFlorio would likely deny it to the hilt, it's pretty obvious where this came from. Your voice at City Hall? Don't think so. |

True, Rosa will try to put the Mayor's spin on this item. It is probably something that the Attorney General, Secretary of State and Campaign finance should look into. Robert has it scheduled for next week's BOA so that should be a more telling issue. |
