Is that date for all of them, or just a few?

If freddie retires prior to a conviction, does he still lose his pension?

I think so. That happened to Jackie Bulger, if I recall correctly.

Inspector General's Investigation Leads to Everett Indictments

--------------------------------------------------------------------------------

The Office of the Inspector General, the state Attorney General and the Massachusetts State Police on March 26, 2004 announced 41 indictments against 11 individuals and five companies charged with defrauding the Everett Public School system.

The indictments alleged that at least 63 contracts worth more the $552,000 were obtained by fraudulent means including conspiracy, procurement fraud, bid rigging, bid splitting, presentation of false claims, larceny, receiving stolen property and kickbacks between local businessmen and City of Everett Public School employees from 1998 to 2003.

As a result of this investigation, Everett Superintendent of Schools, Frederick Foresteire, was also indicted on one count of receiving stolen property. The indictment alleges that Everett Public School maintenance manager, Lona DeFeo, and Louis Grande, Foresteire's ex-brother-in-law, allegedly stole two Everett Public School air conditioners worth over $1,850 and had them installed at Foresteire's home.

Grande was the largest benefactor in the alleged plan to defraud the Everett Public Schools. Grande allegedly participated in numerous bid-rigging and kickback schemes with two other "straw" companies to get around the Commonwealth's sealed bidding process and receive EPS contracts worth over $250,000.

In the fall of 2004, three individuals and two companies plead guilty to charges arising from the Inspector General's investigation and agreed to pay restitution and fines back to the Everett Public Schools:

Anthony Fabrizio, Sr. of Burlington, plead guilty to conspiracy to commit procurement fraud;
Roy A. Merenda of Malden, individually and as the owner of Roy Merenda & Sons, plead guilty to one count each of procurement fraud and conspiracy to commit procurement fraud; and
Victor Silva of Haverhill, individually and as the owner of United Building Services plead guilty to one count each of procurement fraud and conspiracy to commit procurement fraud.

The way the courts work, what will happen is another postponement because of xmas. The backup will probably make the date sometime in Feb.

Do you think the school committee will change his contract? That was part of the audit that they were not changing, as they were told to. He has a revolving contract now, every year that expires gets renewed on the back end. Does anyone know who pays for his lawyer? Does that get covered by the school dept. budget?

Let me prequalify this by saying this is only a supposition based on my experience working with the schools over in Chelsea and what I have read about the Everett school committee in editorials in the papers.

I'm sure the school dept budget can cover the legal costs of any school-related issues (loosely defined as issues that the committee deems to be school-related). Even if he was suspended and replaced by an interim superintendent, I still think the school committee would be able to pay for his lawyer out of the budget by a simple vote. There is no oversight outside of the school committee, so there is no stopping them. Therefore, unless our superintendent decides for the good of the budget to pay for legal fees out of his own ample pockets, the school budget will certainly cover it. But he doesn't strike me as the most generous guy around, so I'd be willing to bet it is in the school budget. Is this illegal?

I'm very curious to know if anyone knows of any rule that would prove me wrong here or could clarify the legality of covering personal legal fees of a contracted state/municipal employee. It has certainly been done before on a national level (see the Clinton administration as well as the ethics violations recently by the house speaker). Unless the public raises an outcry about this question, it won't be an issue.

Another item to add to the list of documentation we request from the city and school department for our ethics complaint.

My pal has a friend who offered to review the complaint, and this will definitely be asked.

So, I don't know the answer, but will find out.

I dont know when Freddy is due for retirement but his buyout Bulger-esque, i believe that if he is terminated before he is convicted than there is 3 or 4 years left on the deal at about $150,000 per year remaining. Also this contract was given to him first in 1999 and was deemed illegal by the DOE. And in 2002 they gave him a similar deal and the "weasels" voted for it again. As for the three handlers, Wallace has already retired, Dolan is still there, and the ultimate umbrella holder Malione will be attached to Freddy for the rest of his days. WHAT A DISGRACE!!!!!!!!!!

Justthefcts - there is no termination clause in Fred's 2002 contract, and the state auditor made the recommendation that the contract be reopened and amended. The school committee was supposed to take that issue up - and I am not sure where it is at this point.

Wasn't Dolan supposed to retire at the end of September? And didn't a number of other administrators, as well? Geez, I just heard the theme song to Jaws.....

And Wallace retired, but isn't he back on board as a "consultant" along with John Cook Dowd -- another one who wasn't put into the budget because he was supposed to be "retired"?

I heard today that Joe Guilliano is in the hosptial he had a severe heart attack/where does that leave the school committee
