If people want answers this is what you can do. If nothing is done and this deal goes through, the responsibility is on them. At least we know that the council knew in advance and they will have no excuse. They asked for the position, now they have to go to work.

and write to every Board of Alderman and Common Councilor. Keep copies of what you send them and when. Request a response from them and ask what they intend to do about it. You can email them or write them letters, which ever is more convenient. THEY KNOW VERY WELL THIBEAULT WANTS LOWER BROADWAY FOR THE TRUCKING AND IM SURE THERE IS A DEAL WITH SOMERVILLE AND BOSTON TO TAKE THEIR TRASH. They work for us and now that the going gets tough, they need to prove they are there for the people.
This is happening right now. If you procrastinate, we will be stuck with this and if you think this is bad, just wait. It will only get worse but our health and our children's health will be the issue.
We don't want something like this to happen because Thibeault is untrustworthy and non-compliant.

I think what's meant by trash is stories like this Dated March 24, 2008. This man does not belong in Everett. We are asking for big trouble. Just look at Boston Street and I too believe there is some kind of deal to take waste from Somerville and Boston. Filling his pockets while we suffer like we are the dummies. These dummied will show him.
DEP: Landfill owner shut off odor control City calls action retribution for latest order
NEWBURYPORT — Just days after receiving another cease and desist order from the city, the owner of the Crow Lane Landfill "manually and intentionally" shut down the device that helps dissipate the noxious smells from the dump, according to state officials.
As a result, many nearby homeowners suffered through days of nauseating odors. The device was shut down from Monday to Wednesday morning, the state Department of Environmental Protection said.
And while it is unclear whether the action — which shut down the gas extraction system and a flare that burns off the gas — was in response to the city's ruling, Jack Morris, the city health agent, said "absolutely" it is retribution.
"It just shows the attitude of New Ventures," Morris said, referring to the landfill owner.
Furthermore, the DEP, which ordered New Ventures to turn the system back on, also hand-delivered another letter to New Ventures' attorneys Thursday to tell them they have continually failed to abide by a 2006 preliminary injunction and that the department would, within 14 days, put the company on "default notice."
Morris said the default notice is the "first procedural step to access" the $3 million financial assurance mechanism, or FAM, which ensures there is money to take corrective action to shut Crow Lane.
"I think they've just about had it," Morris said of the DEP's attitude toward New Ventures. "I think there is going to be a lot going on in the next week or two."

For the last half decade, the Crow Lane landfill has wreaked havoc on the lives of its neighbors. The smell of rotten eggs and burnt matches wafting from the dump disrupts the lives of many residents, causing sore throats, burning eyes, headaches and restless sleeping.
Throughout the years, both the state and local government have fought to fix the problems through fines, injunctions and court rulings, but nothing has been successful.
Just last week, the Board of Health shut down the facility for failing to develop a corrective action plan to fix numerous problems at the site. New Ventures had appealed the original order to develop that plan, but asked for a continuance at a meeting scheduled for Thursday night.
The corrective action plan was supposed to be issued within seven days, and the company was supposed to complete those actions by March 14. The company did neither, forcing the city to issue the cease and desist order, which stops new Ventures from bringing in material to the dump.
"Corrective actions were required immediately to address adverse nuisance odors, the uncontrolled breakout and runoff of leachate, and properly covering exposed areas of the landfill to prevent the generation of leachate from infiltration of storm water and other precipitation," the letter said.
Ron Klodenski, a member of the ad hoc landfill committee and a leading advocate for neighbors dealing with the site, said the recent decisions by the city and the state are hopeful.
"They are not letting (Thibeault) get away with it," he said. "Obviously the DEP came right out and it appears they are paying attention. I'm hoping this leads to something good. |

City orders Crow Lane closed; awaiting compliance By Alyson Aiello/Correspondent Thu Mar 20, 2008, 11:01 PM EDT Newburyport
Newburyport - The city of Newburyport has again ordered the Crow Lane landfill to shut down until owner New Ventures LLC meets the terms set forth in a Feb. 26 cease and desist order.
The latest cease and desist issued March 14 shuts down all operations and allows only the delivery of clay used to meet a previous requirement for covering the landfill. Delivery must be stopped completely of any soils, asphalt grindings or berm materials other than the required clay.
The March order, issued by the Board of Health, stated that New Ventures had been ordered to “develop a corrective action plan and submit said plan to the Health Department within seven days and complete corrective actions on or before March 14, 2008.”
John Morris, health board director, said that because no plan had been submitted by the required date and because no “adequate” action had been taken, he had no choice but to issue the order.
“There has not been anything done that corrects the violations,” he said.
On March 7, lawyers for New Ventures requested a hearing before the Board of Health, which was to take place last night (after press time). Lawyers told the city, according to Morris, that a plan had been developed by the site’s engineer of record and would be discussed at the hearing.
But according to the order, the city “clearly indicated that the plan and corrective actions were required immediately to address adverse nuisance odors, the uncontrolled breakout and runoff of leachate, and properly covering exposed areas of the landfill to prevent the generation of leachate from infiltration of storm water and other precipitation.”
Morris said the hearing might address both orders but did know exactly what to expect.
“I’m not sure what their strategy is,” he said. “But they don’t seem to comply with anything they’ve agreed to.”
Attorney Chip Nylen, of the New Ventures legal team, declined to comment. As complaints about nuisance odors from the landfill continue to come into the city, Mayor John Moak hopes to see corrective action taken sooner rather than later, but he isn’t positive he’ll see those hopes realized.
“I hate to say this, but there aren’t a lot of positive things about the landfill,” he said.
Moak is disappointed that the company continually fails to meet what was asked of it, so he supports the orders issued by the Board of Health.
In a July preliminary injunction, eight actions were requested of New Ventures, including: correcting issues with leachate tanks, providing the health department access to Jerome meters, providing adequate staffing, and generally progressing toward capping the landfill.
“These are not subjective problems,” Moak said. “These are strictly technical things they’ve not completed.”
Ron Klodenski, a member of the ad hoc landfill committee made up of concerned citizens, has his doubts as well. In fact, earlier this week he wasn’t sure that a hearing would even happen. He theorized that the New Ventures legal team might even ask to rescind the order.
“It’s a complicated mess, legally and otherwise,” Klodenski said.
The ad hoc committee was scheduled to meet prior to last night’s hearing. |

I think if the city puts enough effort into planning they can put the proper safeguards in place to keep WoodWaste in line at a different location. It seems pretty simple, put the buildings up first......then you can occupy the site. There has to be some sort of occupancy permit required before he can move (similar to the scrap metal dealers licenses). If not, I think time would best be spent lobbying our CC and BoA to create such a permit. |

I can not understand why the Mayor is blowing his election in office out the window. I keep coming back to “why now” if it’s just a waste transfer station perhaps there is a link to this being in place once the sludge plant is complete.
Talk is Thibeault’s plan is to haul the waste out of the transfer station by barge and I cant figure out why….. unless there are plans to purchase a fleet of barge boats, just in time for the next election. I think there is a lot of money in it for someone contracted to haul garbage from a brand new waste transfer station and a sludge treatment plant by barge.
This goes back on a deal with Somerville (the mayor’s good friend) and possibly Boston. We are talking about hundreds of thousands of dollars a year.
The only thing that I am totally convinced of is there is something underway that will make all the players quite rich regardless of what takes place next election.

Demaria knew during the campaign that the sludge plant was already a done deal and he promised no businesses like this would go there. He is the one who said, office condos, shopping mall, marina, water taxis and that was all he would consider. He even answered the concerns about Teebow on Boston Street and said Teebow will abide by DEP rules and Teebow (The developer) would build office condos at the old city yards.
Now..Hanlon receives a letter about FFF and does not "immediately" inform the council. They had him on the floor the very next meeting and that went on and on for weeks. Was that issue petty..no....but very petty compared to this issue.
So you say who would develop there? Its okay for residents to live there but not okay for office condos that clock in at 9 and leave at 5. Like they are better than anyone of the residents that own their homes or live on lower Broadway? They pay taxes like everybody else and already have enough to deal with. Teebow needs to enclose Boston Street and make that facility right. His plan was to build office condos. If he does that then fine, if not show him the door and tell him don't look back.
