In regards to the residency ordinances, someone asked me a question last night that I have posed here before but I'm still not sure that I'm clear on the answer to. The question is how do the residency ordinances fit in with the existing police and fire collective bargaining agreements? I know that either the acting city solicitor or the mayor's chief of staff gave an answer to the question: but, does anyone understand the situation enough so that they can explain it so that even I can understand it?

I did a little research this morning on the City of Somerville web site to see if that could shed any light on the issue. They have had a residency ordinance for all city employees since 1978. Since their ordinance applies to all employees, it is contained in a section of the ordinances that applies to all city employees and there is no mention of a need for the residency requirement to be included collective bargaining agreements. When I looked under the section of their ordinances that apply to the police department, there was nothing there either. However, when I got to the section of their ordinances that apply to the fire department, there was an ordinance that stated that any residency requirements for members of the fire department needed to be collectively bargained. I didn't go on any other departments after that.

I'm not sure what's right and maybe I'm making more out of this than need be. However, no matter how you feel about the residency ordinances, if they do pass, I think that we all would hope that they are air-tight enough so that they can not me immediately challenged.

I'm flip flopped on the issue. I hear both sides of the argument and I would hate to be the deciding factor on this residency rule. What was even more confusing to me was there were three pieces on it. One at the BOA, one still at the Mayor's office...and I have no idea where the other one was. One said ten years on residency the other five. If Alderman Marchese put the original piece on, it should stay as one piece or decide on amending it... in committee...then back to the BOA. There seems to be too much confusion when the CC gets it then they change it...then it becomes a new item on the calendar. Seems like so much wasted time.

Let me try to help out a little bit, at least with the procedural side of the issue. At the Common Council Meeting of March 3, it was recognized that the residency ordinance was lacking, even to the point of not having a specific ordinance section or number. At that time, the item should have been referred back to the rules and ordinances committee for further work. Instead, the mayor requested that the item be sent to his office. This was a mistake. Remember the last time that the council referred something they should have been working on to the mayor? How well did work out? Though hardly on that scale, this item should have gone to R&O where the members of that committee, the original sponsor, the acting city solicitor and the mayor's office should have worked out all of the details.

However, since that did not happen, what should have happened is that the mayor's office should have reintroduced their proposal to the common council, since that was the body that referred out the original item. The original item should have been returned with a request to kill it, i.e., refer to the BOA so that it could be referred back to sponsor (I guess). The mayor's office's proposal to split the ordinance into two seperate ordinances was the right thing to do since it is an ordinance that only applies to those two departments and each of those departments has their own sections in the city's ordinances. I posted about the police vs. fire chief exclusion last night because I thought that it might not be caught. As the mayor's chief of staff later explained that was not their intention, rather a simple omission.

Hope that the information helps. A messy situation all around that didn't need to be that way.

Ahh...Thank you, that explains it to me. Your right, it should have gone to R&O and that would have made more sense.I'm interested in the final outcome of this.

For completeness sake, even one more procedural clarification on the residency ordinance. At the BOA meeting of 02/25/2008, the issue was returned from the Administrative Affairs committee with an unfavorable recommendation. Even so, the board chose to keep the item going. This was the actual point where the item should have referred to R&O since no ordinance had yet been drafted. Instead, the board chosen to enroll it (what did they enroll?) and send it on to the Common Council. I am really surprised that the city clerk or the clerk of committees didn't catch it that time.

Things seem to be getting really sloppy all over city hall.

I had another small issue with the BOA meeting last night. It's not a big deal and I'm sure it's been done this way forever...so it's no one's fault ....but it seemed to me that the Community Development office and the Engineering Office do not communicate. Every time Community Development is up there, they always say "that's engineering" then when engineering is up there, they always say "that's community development" and we never get any answers. If any office is to be merged, they should merge those two offices, then they will all be on the same page. Also, taking all these years to get a street fixed is totally ridiculous. That system they have is NOT working. This has been an on going problem for years but this would be a nice thing to correct and work on. Seems to me that nothing ever gets done or it takes too long. So many streets have fallen through the cracks over the years and the work gets lost. That's unacceptable with the condition of the library stairs, Fuller Street, the dead end forgotten streets, all the construction on lower Broadway, it goes on and on. I think the focus should be those office's. They should have been looked at before the Veterans Office too, that's for sure.

MWRA........So much for not hiring family and friends. That's all I have been seeing. I'm mad because more lies just like I said in the past I was told Thibeault would NOT be moving his dump to lower Broadway and the before the election I was told it would be office condos. This was huge for me and I was adamant about it. I feel becasue I am a nobody that I just don't count. See below were he even admits it was Mr. Hanlon that got him elected and he was tossed to the curb. He's following the money not standing up for people. People have been suffering on the parkway for years and now we reward Thibeualt! There are alternative revenue instead of a dump. See below were he even told the globe his lies, especially about Thibeualt.



Mayor-elect is off to running start

Barely 12 hours after DeMaria, the city's alderman at large, captured the top job in Tuesday's general election, he said he'd already set up meetings for this week with area mayors to get a feel for how they are handling several key issues.

"I just want to talk about working together as area mayors on development in the city, just making the city as safe as possible and talking about their issues with public safety, and what policies they have instituted to save taxpayers' money," DeMaria said.

One big-ticket item DeMaria said he would especially like to explore with other mayors is whether to join the Group Insurance Commission, a state-run health insurance program that can save cities and towns significant sums on their insurance coverage for municipal employees. He said he also intends to pursue "aggressive" recycling campaigns to reduce hefty trash disposal fees and, additionally, will encourage "clean" development plans by Wood Waste of Boston owner William Thibeault for roughly 30 acres near his property on Revere Beach Parkway.

Thibeault, who is suing the city, was a DeMaria campaign supporter.

"He's got a master plan to develop it all and in that plan is tax dollars and it's clean development," DeMaria said. "He has an idea to bring in retail outlets like Lowe's and Loews Theaters, and he has had a major hotel chain contact him about moving down there."

DeMaria, 34, defeated his Board of Alderman colleague and president, Joseph McGonagle, 48, by 313 votes, winning 13 of 18 precincts. The final tally was almost a mirror opposite of September's preliminary election, when McGonagle captured 13 precincts and bested DeMaria by 385 votes in a four-way race that ousted Mayor John Hanlon.

Now, DeMaria, who chided Hanlon during the primary for bloated budgets and payrolls, says Hanlon's support in the general election gave him the winning edge.

"It was huge," Demaria said. "Yeah, people were upset with him for taxes going up, but that wasn't all his fault. He paid off a lot of debt from the prior administration and . . . he funded the pension system that was neglected for years."


Hanlon, who came in third in September's election, said he sent out letters to the roughly 1,700 people who supported him in that race, urging them to back DeMaria. And, he said, he spent all Election Day on the phone, reminding them to vote. Just 44 percent of the city's roughly 17,700 voters went to the polls. DeMaria captured 51 percent of the vote, to McGonagle's 47 percent.

"I thought Carlo would win," Hanlon said. "But I thought he would win by more."

City Clerk Michael Matarazzo, who served 18 years on the city's council and has been involved in politics for 30 years, said this election was anything but textbook.

"There was no political feel out there about exactly what was going to happen or where the momentum was," Matarazzo said. "It changed daily."

Matarazzo said the last time he was so stumped about the outcome of a race was in 1990, when he worked as a field director in William Weld's 1990 gubernatorial campaign.

In Everett, where politics can be a bruising sport, this mayoral race was marked by allegations of foul play.

In the closing weeks of the campaign, McGonagle said his tires were slashed, a campaign worker's windshield was smashed, and that two young women who were canvassing neighborhoods in late October were intimidated and "harassed" by a male who grabbed their clipboard and demanded to know what they were doing.

A police report filed by McGonagle and the two women on Oct. 23 identifies that man as DeMaria.

Two hours after that report was filed, police records show that DeMaria came into police headquarters to file a "rebuttal," denying the allegations and stating that he was accompanied at the time of the alleged incident by two people who would "attest that he didn't do what was alleged."

Asked about the alleged incident after the election, DeMaria declined comment.

"I think it was them who played dirty from day one," he said. "I want to move on. I have been preaching a new beginning for the city."

So Tails you don't think a Civil engineer is good qualifications to be on Everett City Services Commission? What kind of qualifications should the Mayor be looking for for City Services?

I did not read anywhere in Tails post that a civil engineer was not qualified for the Everett City Service Commission. The point I received from reading his/her post was that Mayor DeMaria told his supporters, he would not be hiring family and friends. Tails said nothing about Carmine DeMaria's qualifications.
